Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Her selection also considers a wide range of legal forums, including administrative rulings by municipal councils, criminal trials before police magistrates, and criminal and civil cases heard by the highest courts in the provinces and by the Supreme Court of Canada. The extensive and detailed documentation presented here leaves no doubt that the Canadian legal system played a dominant role in creating and preserving racial discrimination. A central message of this book is that racism is deeply embedded in Canadian history despite Canada's reputation as a raceless society. Indigenous law, however, has continuing relevance for both Aboriginal peoples and the Canadian state. In his in-depth examination of the continued existence and application of Indigenous legal values, John Borrows suggests how First Nations laws could be applied by Canadian courts, and tempers this by pointing out the many difficulties that would occur if the courts attempted to follow such an approach. By contrasting and comparing Aboriginal stories and Canadian case law, and interweaving political commentary, Borrows argues that there is a better way to constitute Aboriginal / Crown relations in Canada. He suggests that the application of Indigenous legal perspectives to a broad spectrum of issues that confront us as humans will help Canada recover from its colonial past, and help Indigenous people recover their country. Borrows concludes by demonstrating how Indigenous peoples' law could be more fully and consciously integrated with Canadian law to produce a society where two world views can co-exist and a different vision of the Canadian constitution and citizenship can be created.

The site was discovered & first excavated in the early 1950s but work was never completed and the site remained enigmatic and controversial. Reinvestigation of existing collections of site material and renewed field investigations began in 1989-1990. This book brings together available information on the site, including the re-investigations and subsequent research on the site's geological and paleoenvironmental history. It begins with a history of the initial investigations of the 1950s and continues with chapters on the role of heritage planning in the re-investigations, geoarchaeology, projectile point artefacts, Quaternary geology & stratigraphy & sedimentology of the site, upper Great Lakes climate & water level changes since 11,000 years ago and their effects on the site, the geological history of the site, and the characteristics of quartzite & other potential sources of raw material for the artefacts. The final chapter synthesizes archaeological conclusions regarding the Sheguiandah site and its contribution to the understanding of Paleoindian & subsequent occupations in the upper Great Lakes.

Book excerpt: Cary Miller's Ogimaag: Anishinaabeg Leadership, 17601845 reexamines Ojibwe leadership practices and processes in the late eighteenth and early nineteenth centuries. At the end of the nineteenth century, anthropologists who had studied Ojibwe leadership practices developed theories about human societies and cultures derived from the perceived Ojibwe model. Scholars believed that the Ojibwes typified an anthropological "type" of Native society, one characterized by weak social structures and political institutions. Miller counters those assumptions by looking at the historical record and examining how leadership was distributed and enacted long before scholars arrived on the scene. Miller uses research produced by Ojibwes themselves, American and British officials, and individuals who dealt with the Ojibwes, both in official and unofficial capacities. By examining the hereditary position of leaders who served as civil authorities over land and resources and handled relations with outsiders, the warriors, and the respected religious leaders of the Midewiwin society, Miller provides an important new perspective on Ojibwe history.

Book excerpt: The Fry site (33Lu165) was an Ottawa (Odawa) farmstead on the lower Maumee River of Ohio that existed A.D. 1814-1832. Excavations revealed an Ottawa bark burial with trade goods, a cabin or shack, and an animal pen or compound. The material culture consisted of a wide variety of Native and Euro-American manufactured artifacts, including trade silver. The bark burial with trade goods is dated A.D. 1780-1809, slightly earlier than the farmstead occupation. The farmstead is connected with the Roche de Boeuf and Wolf Rapids bands of Ottawa that were removed to Kansas Territory in 1832. The Ottawa Tribe of Oklahoma are the descendants of these Maumee River Ottawa.

Well aware of the limitations placed upon women advocating for reform in a patriarchal legal system, Constance Backhouse recreates vivid and textured snapshots of these and other women’s courageous struggles against gender discrimination and oppression.
