Book excerpt: The 2008 turmoil in the financial markets provided the primary impetus for significant financial reform of U. S. financial service institutions. The profound economic disruption had multiple causal factors, including, in part, the widespread use of privately negotiated over-the-counter derivatives instruments. Transactions outside the structure of exchanges or centralized clearing facilities did not universally face collateralization, margin and transparency typically associated with exchange traded derivatives. As a consequence, a significant volume of derivatives transactions lacked the limiting brakes of traditional collateral and were largely opaque to financial service regulators. These, and other factors, magnified structural and regulatory gaps that accelerated economic and financial challenges in U. S. and global markets.On July 21, 2010, President Obama signed the Dodd-Frank Wall Street Reform and Consumer Protection Act (“Dodd-Frank Act”) into law. Title VII of the Dodd-Frank Act amends the federal commodities and securities laws to establish a comprehensive new regulatory framework for swaps. The legislation seeks to reduce risk, increase transparency, and promote market integrity within the financial system by, among other things: (1) Providing for the registration and comprehensive regulation of swap dealers and major swap participants; (2) imposing clearing and trade execution requirements on standardized derivative products; (3) creating robust recordkeeping and real-time reporting regimes; and (4) enhancing the rulemaking and enforcement authorities of the SEC and CFTC with respect to, among others, all registered entities and intermediaries subject to the Commission's oversight. To implement the Dodd-Frank Act, the agencies issued 55 advance notices of proposed rulemaking or notices of proposed rulemaking, two interim final rules, 12 final rules, and one proposed interpretive order. These collective actions represented a significant new regulatory framework under Title VII of the Dodd-Frank Act. The revised laws and regulations bore directly on life insurers' management of their asset and liability risks through derivatives hedging. This document demonstrates a series of substantive advocay approaches to unique regulatory initiatives in different venues essential to constructive rulemaking under the Dodd-Frank Act.

Book excerpt: Although bearing striking similarities to each other in many respects, securities investments, non-securities derivative investments, insurance and gambling are subject not only to different regulatory regimes but also to vastly different levels of government interference. Traditionally, stringent prohibitions characterize the insurance and gambling industries, whereas regulation of investments in securities and derivatives occurs primarily through disclosure requirements. Also there is striking contrast in the current approaches taken to securities and non-securities derivatives regulation. If, however, these activities are so similar in nature, does a rational basis exist for widely differing regulatory schemes? If no rational basis can be found how do we identify whether the current deregulation trend moving through the derivatives markets is a sensible change when regulation in the securities market is increasing? This article ultimately questions the absence of a consistent approach in regulating securities, nonsecurities derivatives, insurance and gambling. Among other things, the article questions whether deregulation of the derivatives market is a prudent maneuver in light of its similarities with more heavily regulated activities.

The committee looked at the consequences of being uninsured for people suffering from cancer, diabetes, HIV infection and AIDS, heart and kidney disease, mental illness, traumatic injuries, and heart attacks. It focused on the roughly 30 million-one in seven-working-age Americans without health insurance. This group does not include the population over 65 that is covered by Medicare or the nearly 10 million children who are uninsured in this country. The main findings of the report are that working-age Americans without health insurance are more likely to receive too little medical care and receive it too late; be sicker and die sooner; and receive poorer care when they are in the hospital, even for acute situations like a motor vehicle crash.

The ongoing opioid crisis lies at the intersection of two public health challenges: reducing the burden of suffering from pain and containing the rising toll of the harms that can arise from the use of opioid medications. Chronic pain and opioid use disorder both represent complex human conditions affecting millions of Americans and causing untold disability and loss of function. In the context of the growing opioid problem, the U.S. Food and Drug Administration (FDA) launched an Opioids Action Plan in early 2016. As part of this plan, the FDA asked the National Academies of Sciences, Engineering, and Medicine to convene a committee to update the state of the science on pain research, care, and education and to identify actions the FDA and others can take to respond to the opioid epidemic, with a particular focus on informing FDA's development of a formal method for incorporating individual and societal considerations into its risk-benefit framework for opioid approval and monitoring.
