Book excerpt: Excerpt from Representation in Virginia By a charter dated April 10, 1606, James I authorized the settlement of two colonies in the territory of Virginia. Each colony was to have a resident council Of thirteen to govern according to the laws and ordinances constituted by the king. In addition to these, there was to be one supreme council in England having control, under the supervision of the king, of the government of the two colonies.' Following this charter, on November 20, 1 606, James issued the articles Of government for the two colonies.2 These were the laws by which the colonies were to be governed. James appointed the Council Of Virginia (the council residing in England), granting it no power or authority except at his pleasure and will. It was simply to have the power to appoint the subordinate councils that were to reside in Virginia, and to give directions for the governing of the same. Some of them had decided that it was a contract between the governed and the governors; others believed all power belonged to the people; others were content to trace its origin to the family relation, and others thought that rulers derived their right to rule from the Supreme Ruler of the Universe. In the beginning of the settlement of America these questions were not of practical importance, for pioneers in a wilderness had only problems of personal government to deal with. Questions of liberty did not obtrude themselves upon men who could go at will through a boundless country and make their homes wherever they pleased. The Jamestown court book, which begins in 1622 and is the earliest government record of the English occupation, shows this, for the chief function of the government was to punish small offences against law and order, and wrongs committed by one man against another. A hundred years later, however, governmental conditions had become more complex, the country having passed the earliest pioneer stage, having increased greatly in population and having become valuable to the nation which owned it. When that nation began to restrain its American subjects, to exercise authority over them and to tax them, neglected theories of government were revived and they began to study them with a practical object in view. They felt that they were ill-used, and read and discussed so as to give form to their grievances. Ready at hand was the classic literature of Athens and Rome which all educated men knew fairly well. The civilization of those states was understood and entered into the daily thought of the time. When the Americans came to create governments of their own they adapted to their use some of the institutions and nomenclature of the classical period. It would be beyond the scope of this article, however, to try to find the classical spring of the thoughts which were in the mind of George Mason when he wrote the Declaration of Rights and of Thomas Jefferson when he wrote the Declaration of Independence, nor is it necessary to do so, for their immediate inspiration came from more modern sources. As to the general bearing of this chapter of colonial upon the progress of English political life in general, Gardiner's standard work, to which I like to appeal in these walls, and which has just undergone the test of a searching critical estimate from an able American pen, is not likely to be left neglected. Book excerpt: Excerpt from Official Virginia: A Composition of Sketches of the Public Men of Virginia at the Present Time About thirty years ago, it was the good fortune of this writer to be employed in the capacity of a confidential clerk by a gentleman whose ability was recognized all over the State. He had a head two stories and a half high, with a large attic on top, and was possessed of a master mind very little short of the first order of greatness. This man began life a very poor boy, and yet by dint of energy and intellect long before the war, had risen to eminence as well as competency. When the clouds of war were gathering in 1860 and Virginia was alarmed like all her other sister Southern states as to the outcome of Mr. Lincoln's election, he was chosen a member of a convention which will go down in history as the Secession Convention. In that body he ranked with such intellectual giants as Barbour, Baldwin, Alexander, H. H. Stuart, and others. He was a Union man when he went to the Convention and so remained until Mr. Lincoln issued his proclamation calling on Virginia to furnish her quota of troops to coerce her sister Southern states. Like every other Union man from the South, he then cast his lot with his section. When the war ended and his State was beneath the heel of the carpet-bagger and the scalawag, Virginia, in order to come back into the Union on a constitutional basis, selected this gentleman, Mr. Stuart, Mr. Barbour and Mr. Baldwin to visit Washington and interview President Grant in order to obtain his consent for Virginia to resume her rightful place once more in the Union.
