Book Reports of Decisions in the Supreme Court of the United States Vol 1

This book was released on 2017-10-18 with total page 700 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Reports of Decisions in the Supreme Court of the United States, Vol. 1: With Notes, and a Digest This work contains the decisions of the Supreme Court of the United States. The opinions of the court are in all cases given, as they have been printed by the authorized Reporters, after correcting such errors of the press, or of citation, as a careful examination of the text has disclosed. I have endeavored to give in the head notes, the substance of each decision. They are designed to show the points decided by the court, not the dicta or reasoning of the judges. The statements of the cases have been made as brief as pos sible. For many years, it has been the habit of all the judges of this court, to set forth in their opinions, the facts of the cases, as the court viewed them, in making their decision. Such a statement, when complete, renders any other superfluous. When not found complete, I have not attempted to restate the whole case, but have supplied, in the report, such facts, or documents, as seemed to me to be wanting. In some cases, turning upon questions, or complicated states of fact, and not involving any matter of law, I have not thought it necessary to encumber the work with detailed statements of evidence, which no one would find it useful to recur to. These instances, however, are few. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book The Oxford Guide to United States Supreme Court Decisions

Download or read book The Oxford Guide to United States Supreme Court Decisions written by Kermit L. Hall and published by Oxford University Press. This book was released on 1999 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Democracy in America, De Tocqueville observed that there is hardly a political question in the United States which does not sooner or later turn into a judicial one. Two hundred years of American history have certainly borne out the truth of this remark. Whether a controversy is political, economic, or social, whether it focuses on child labor, slavery, prayer in public schools, war powers, busing, abortion, business monopolies, or capital punishment, eventually the battle is taken to court. And the ultimate venue for these vital struggles is the Supreme Court. Indeed, the SupremeCourt is a prism through which the entire life of our nation is magnified and illuminated, and through which we have defined ourselves as a people. Now, in The Oxford Companion to the Supreme Court of the United States, readers have a rich source of information about one of the central institutions of American life. Everything one would want to know about the Supreme Court is here, in more than a thousand alphabetically arranged entries. There are biographies of every justice who ever sat on the Supreme Court (with pictures of each) as well as entries on rejected nominees and prominent judges (such as Learned Hand), on presidents who had an important impact on--or conflict with--the Court (including Thomas Jefferson, AbrahamLincoln, and Franklin Delano Roosevelt), and on other influential figures (from Alexander Hamilton to Cass Gilbert, the architect of the Supreme Court Building). More than four hundred entries examine every major case that the court has decided, from Marbury v. Madison (which established the Court'spower to declare federal laws unconstitutional) and Scott v. Sandford (the Dred Scott Case) to Brown v. Board of Education and Roe v. Wade. In addition, there are extended essays on the major issues that have confronted the Court (from slavery to national security, capital punishment to religion, from affirmative action to the Vietnam War), entries on judicial matters and legal terms (ranging from judicial review and separation of powers to amicus brief and habeas corpus), articles on all Amendments to the Constitution, and an extensive, four-part history of the Court. And as in all OxfordCompanions, the contributors combine scholarship with engaging insight, giving us a sense of the personality and the inner workings of the Court. They examine everything from the wanderings of the Supreme Court (the first session was held on the second floor of the Royal Exchange Building in NewYork City, and the Court at times has met in a Congressional committee room, a tavern, a rented house, and finally, in 1935, its own building), to the Jackson-Black Feud and the clouded resignation of Abe Fortas, to the Supreme Court's press room and the paintings and sculptures adorning the SupremeCourt building. The decisions of the Supreme Court have touched--and will continue to influence--every corner of American society. A comprehensive, authoritative guide to the Supreme Court, this volume is an essential reference source for everyone interested in the workings of this vital institution and inthe multitude of issues it has confronted over the course of its history.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Notes on the United States Reports, 1899, Vol. 1: A Brief Chronological Digest of All Points Determined in the Decisions of the Supreme Court, With Notes Showing the Influence, Following and Present Authority of Each Case, as Disclosed by the Citations, Comprising All Citing Cases in That Court The many novel features of this publication justify a somewhat detailed statement of its scope and the method of its preparation. Broadly speaking, it consists of two classes of matter first, chronologically arranged syllabi of all points of law determined in the Supreme Court decisions; and second, notes appended to such syllabi, based upon and collecting all the subsequent citing cases pertaining thereto. These citation notes are prepared by the editors from complete numerical tables of citations which disclose as to each case all the subsequent cases in which it has been cited in the Supreme Court, the intermediate and inferior Federal courts, and the courts of last resort of all the States of the Union. Proceeding upon the theory that the profession wants some thing more than bald, unclassified numerical tables of cita tions, the notes aim to present complete citation information respecting each case in the most orderly and available form; and to that end the citing cases are so classified and dis cussed as to show the points to which they cite, their nature, their application of the cited principle, and their general efl'ect. Book excerpt: Excerpt from Reports of Cases Argued and Adjudged in the Supreme Court of the United States, Vol. 1: In August and December Terms, 1801 and February Term, 1803 Much of that uncertainty of the law, which is so frequently, and perhaps so justly, the subject of complaint in this country, may be attributed to the want of American reports. Many of the causes, which are the subject of litigation in our courts, arise upon circumstances peculiar to our situation and laws, and little inform tion can be derived from English authorities to lead to a correct decision.
