The question presented by appellee's counsel, as stated in the opinion. was that "the judgment or order in the case at bar was not such an one as the appellant can appeal from." That this was an order or judgment that might be appealed from there can be no doubt, as it expressly comes Within the exceptions of 658 Burns 1901, 646 R. S. 1881, as has been decided by the Supreme Court in Bronenberg v. Board, etc. (1873), 41 Ind. 502. And while the language of the court in the case under discussion might lead one to infer that the court meant to hold that a judgment for costs was such a final judgment as to form the basis of an appeal, yet this expression must be confined to the case under consideration, and we cannot and do not assume that the court in that case meant to declare not only a new legal principle but one antagonistic practically to all of the authorities, without the citation of a single authority, or the expression of a. single cogent reason therefor. For the foregoing reasons, We hold that the record does not exhibit a final judgment from which an appeal can be taken. Appeal dismissed. No. 5,813. Filed October 10, 1906. An incident that has occasionally occurred, although exceptional in nature, may on its reoccurrence be properly characterized as unusual and extraordinary. Also an event the like of which has never previously occurred, and respecting which there is no reasonable ground for expecting it to occur again, may on its occurrence likewise properly be designated as unusual and extraordinary. It is by reason of the comprehensiveness and flexibility in meaning of the terms under discussion that we are forced to condemn the instruction under 13. consideration.' The instruction by the use of such words unqualified and unexplained outlined a defense broader than the law recog 14. nizes. In such a case as is presented here the defendant may be liable although the flood that concurred with _some act of his was unusual and extraordinary in nature. In such a case the defendant may be held liable in damages not only where the flood was usual and ordinary in nature, but also where it may be designated as unusual and extraordinary, provided its occurrence might have been anticipated by the exercise of reasonable skill and foresight. Vandalta R. Co. v. Y eager, supra. We believe that the qualifying clause is a correct statement of the real test: If the flood under investigation was of such a nature that, in view of all the facts, the exercise of reasonable skill and foresight should have led to its being anticipated, there may be liability. If it was of such a nature that it could not reasonably have been expected to occur, proper care, diligence and foresight being exercised, there is no liability. Excerpt: ...depend upon the question whether a recovery may be had for fright. If it can, then an action may be maintained, however slight the injury. If not, then there can be no recovery, no matter how grave or serious the consequences. Therefore, the logical result of the respondent's concession would seem to be, not only that no recovery can be had for mere fright, but also that none can be had for injuries which are the direct consequences of it. If the right of recovery in this class of cases should be once established, it would naturally result in a flood of litigation in cases where the injury complained of may be easily feigned without detection, and where the damages must rest upon mere conjecture or speculation. The difficulty which often exists in cases of alleged physical injury, in determining whether they exist, and if so, whether they were caused by the negligent act of the defendant, would not only be greatly increased, but a wide field would be opened for fictitious or speculative claims. To establish such a doctrine would be contrary to principles of public policy. Moreover, it can not be properly said that the plaintiff's miscarriage was the proximate result of the defendant's negligence. The injuries to the plaintiff were plainly the result of an accidental or unusual combination of circumstances. which could not have been reasonably anticipated, and over which the defendant had no control, and, hence, her damages were too remote to justify a recovery in this action. These considerations lead to the conclusion that no recovery can be had for injuries sustained by fright occasioned by the negligence of another, where there is no immediate personal injury.-' In Ewing v. The second paragraph alleges, substantially, the same facts as the first, except that it does not negative assumption of risk, and alleges that the pole which plaintifi's hand came in contact with was crooked; that owing to the carelessness and negligence of defendant in using said pole with the crook, causing that part of the pole to be nearer to the hand and arm of plaintiff in giving signals, he received the injuries complained of. A separate demurrer for want of facts was overruled to each paragraph, and an answer was filed in general denial. The cause was submitted to a jury and a verdict returned in favor of appellee. The objections to the first paragraph of complaint are, that it fails to charge a violation of a duty 'owing to appellee. and that the general allegations of the servant's want of knowledge of the alleged defect or danger is overcome by facts specifically alleged, where it appears that the defect and danger were obvious, and nothing is alleged showing want of opportunity to know of their existence.
