H. Browning, Esq., was elected Chairman, and C. B. Lawrence, Esq., Secretary. The Chairman having stated the reasons for calling the meeting, and paid a brief tribute to the character of the deceased, Peter Lott, Esq., offered the following preamble and resolutions: Whereas, it has pleased Almighty God, in the dispensations of his Providence, to cut down in the vigor and usefulness of his manhood, a most esteemed and respected member of this bar, Charles Gilman, Esq., Reporter of the Supreme Court of the State of Illinois, who departed this life on Tuesday, the 24th instant, after a few hours' illness of cholera; therefore Resolved, That we, the members of this Bar, feel with deep sensibility the loss which the profession and society have sustained in the death of our departed brother. Resolved, That we cherish the highest respect for the professional learning of the deceased, for the integrity and uprightness of his professional life, and for the estimable qualities which characterized him as a man, a neighbor and a citizen, and that to testify these sentiments we will wear the usual badge of mourning for thirty days. Excerpt: ...time of the injury; th'e evidence of Captain E. S. Vickery who was in the immediate command of the company at the time; and the evidence of James L. Evans who was surgeon in charge of the Fifth Infantry at the time of the accident and who took charge of Mr. Green immediately after his injury; and the evidence of Dr. E. W. Ames, who was a physician on the field near Mr. Green at the time of the accident; and, also, the evidence of Oliver P. White, who was inspector of rifle range and only a few feet from the petitioner at the time of the injury. These witnesses fully establish the claim of the petitioner and show conclusively that Mr. Green was injured in the line of his duty, acting under the command of his superior oflicers during the encampment at Camp Lincoln in August, 1897; and that he was guilty of no carelessness or negligence whatever on his part contributing to said injury; that the rifle exploded accidentally causing the laceration of the thumb of the left hand of Mr. Green and rendering him permanently injured. The nature of the injury is substantially that of the entire left thumb reaching to the middle line of the palm of the hand to the wrist; that the thumb was blown back on the hand and was hanging by only about three-fourths of an inch of the skin and a little flesh; the bones were badly shattered and the evidence shows about twenty pieces of the bone were taken out of the wound. Considering the nature and extent of the injury as shown by the evidence in this case and that the claimant's thumb is shriveled and stiffened at the joint and that the injury is a permanent one, we are of the opinion that the claimant is entitled to an award of seven hundred and fifty dollars; and that amount is fixed upon by the...

Excerpt: ...and judgment follows; sale is had under execution; title to the property professedly passes to A., who conveys to B., and B. to C. In the course of time the value of the property increases enormously. The judgment debtor now sccks to have the judgment declared a nullity for the reason that the summons was served on Sunday, a nonjudicial day. Under the holding in the Hauswirth Case the attack must bc successful, the judgment and all proceedings thereafter are nullities, and the judgment debtor has the title which by the execution sale professedly passed from him to the purchaser; and, even if the summons had in truth been served on a day other than Sunday, .it is possible to conceive of circumstances in which, long after the judgment was entered and the sale made, the contrary might be proved, thereby destroying that which, for aught the purchasers were able to discover, was a perfect title. Such is necessarily the logical result and effect. of that decision, notwithstanding the remarks on page 213 (6 )Iont., and page 804, 0 Pac.), touching the assignment of a void judgment, and the rights of "innocent third persons" upon execution sale under a judgment void ab inilio. The law does not offer a premium for perjury, and should not permit mere irregularities, which have been waived by the only persons entitled to complain, to overturn solemn judgments rendered on personal service of summons. The serving of a summons is a ministerial act in aid of judicial proceedings. Service made on Sunday is voidable; it will be quashed or set aside when the proper motion in that behalf is promptly and seasonably interposed; but, like any other mere irregularity or imperfection, it may be waived. Objection is also made to the ruling of the court in allowing Nelson Grandchamp, a boy 15 years of age, to testify. Section 2440, Penal Code 1895, is as follows: "The rules for determining the competency of witnesses in civil actions are applicable also to criminal actions and proceedings, except as otherwise provided in this Code." Section 3162, Code of Civil Procedure 1895, is as follows: " The following persons cannot be Witnesses: 1. Those who are of unsound mind at the time of their production for examination. 2. Children under 10 years of age, who appear incapable of receiving just impressions of the facts respecting which they are examined, or of relating them truly." It is argued by appellant that this witness did not sufliciently understand the nature of an oath, and his duties and obligations as a witness. The witness, upon being asked if he understood what he had done when he took the oath as a witness, answered that he did, and that he knew the difference between truth and falsehood and the difference between telling the truth and telling a lie; and that he knew that he was there to tell the truth, and that he knew the truth was that which was so, and not that which was not so, and that he understood he was there to tell what was so. He said the truth did not mean to tell something he did not know, but, on the contrary, meant to tell what he knew. He said he knew that if he did not tell the truth he would be punished. There was a long examination of the witness, and the answers were to the effect above noted. Counsel finally frightened and confused the witness by his questions, so that he stood mute, but when...
