Book excerpt: Excerpt from Reports of Cases Adjudged in the Supreme Court of Pennsylvania, 1812, Vol. 4 Hall for the defendants in error did not deny the importance of the consideration to a deed of bargain and sale; but he said the plaintiffs in error had now placed themselves in the situation of persons asking for a specific performance; and as the court must be satisfied from examining the notes of the trial and the judge's charge, that Quigley had been guilty of shuffling and prevarication to avoid paying for the land, they would not give him the benefit of the objection which had been raised. In reply it was said, that the question did not turn upon the propriety of a specific performance, but upon the point, whether the judge had erred in law in his charge to the jury. If the judgment is affirmed, the opinion of the judge upon all points on which it was delivered, is declared to be good. Tilghhan, C. J. This is a writ of error to the Common Pleas of Northumberland county, founded on the opinion of the president of that court reduced to writing, and filed according to the act of assembly. The plaintiffs had sold to Christopher Quigley one of the defendants a tract of land, for which he had paid a small part of the consideration money, and entered into possession in the year 1791. In 1795, the agents of the plaintiffs tendered to Quigley a deed of conveyance, and demanded payment of the balance of the money. Quigley refused to accept the deed; in consequence of which, the plaintiffs considered the contract as void, and brought this ejectment. Several objections were made to the opinion delivered by the president. I shall take notice of only one of them, because it is decisive. The deed tendered by the plaintiffs was executed by five persons, three of whom were men, and two, married women. It was acknowledged according to law, but there was a blank left for the consideration. There was evidence, that the agent of the plaintiffs was authorized by them to fill up this blank. Under these circumstances, the president of the Court of Common Pleas was of opinion, that the deed was sufficient. Book excerpt: Excerpt from Reports of Cases, Vol. 16: Adjudged in the Supreme Court of Pennsylvania On a writ of error to the Court of Common Pleas of Dauphin county, it appeared that this was a case stated in that court in the nature of a special verdict, in which John Reesor, the defendant in error, was plaintiff below, and John Allen, the plaintiff in error, was defendant, to try which of the parties was entitled to a sum of money in court; arising from recent sales by the sheriff of the real estate of Christian Forney, situate in Dauphin county. John Reesor claimed it under a judgment in his favour against Christian Forney, entered in the said court on the 4th of September, 1819. John Allen claimed by virtue of a recognizance taken in the Orphans' Court of the said county, on the 11th of July, 1818, on which judgment was entered in the Court of Common Pleas, on the 20th of December, 1819. Forney was the surety in this recognizance for James Allen, for the payment to the heirs of the distributive shares of the real estate late of Joseph Allen, deceased, which James Allen had taken at an appraisement made under proceedings in the said court. John Allen was one of the heirs for whose use the recognizance was taken: and the question was, which of the contending parties had the prior lien. The court below decided that the recognizance became a lien only from the time judgment was obtained on it, and gave judgment for the plaintiff below. It was now assigned for error, that such a recognizance was a lien upon all the real estate of the cognizors, both principal and sureties, from its taking. Book excerpt: Excerpt from Reports Cases Adjudged in the Supreme Court Pennsylvania, Vol. 11 Under the circumstances, it is the opinion of the court that the rule for arbitration was illegally entered and the award should be set aside. Though a slight acknowledgment of a debt will take it out of the act of limitations, yet if the debtor qualify his acknowledgment so as to show a determination not to pay, the act will take effect. Therefore where a debtor on being called on for payment of a promissory note, more than six years after it became due, said, that as there had been no money transactions between himself and the plaintiff previous to or during the year 1812, he was surprised at the demand; that he owed him nothing on the of account mentioned, and referred him to his final discharge under the act of 13th March, 1812, it was held, that the debt was barred by the act of limitations, notwithstanding the act of 1812, was unconstitutional and void. The operation of the act of limitations was not suspended, while the act of 13th March, 1812, "for the relief of insolvent debtors residing in the city and county of Philadelphia and their creditors," was held by the courts of this state to be constitutional and valid. In the District Court for the city and county of Philadelphia, a case was stated for the opinion of the court, which, for the purpose of a writ of error, was to be considered as a special verdict. It set forth the following facts. On the 17th of April, 1812, Edward Hudson, the defendant below, drew a promissory note in favour of Cornelius & Andrew Conrad, & Co. for 500 dollars, payable sixty days after date, which was indorsed by the payees to Mathew Carey, the plaintiff. On the 5th of September, 1812, the defendant obtained a certicate of discharge under the act of assembly of this state, passed the 13th of March, 1812, entitled "an act for the relief of insolvent debtors residing in the city and county of Philadelphia, and their creditors." On the 31st of March, 1817, the Supreme Court of the state of Pennsylvania, decided in the case of the Farmers' & Mechanics' Bank v. Smith, 3 Serg. & Rawle, 63, that the said act of assembly was constitutional; and upon a joinder in demurrer to the defendant's plea of a certificate of discharge under the said act, judgment was rendered for the defendant. That case having been removed, by writ of error to the Supreme Court of the United States, the said judgment was on the 13th February, 1821, reversed, on the ground that the said act of assembly of the 13th of March, 1812, was unconstitutional and void.
