Book excerpt: Excerpt from Reports Cases Adjudged in the Supreme Court Pennsylvania, Vol. 11 Under the circumstances, it is the opinion of the court that the rule for arbitration was illegally entered and the award should be set aside. Though a slight acknowledgment of a debt will take it out of the act of limitations, yet if the debtor qualify his acknowledgment so as to show a determination not to pay, the act will take effect. Therefore where a debtor on being called on for payment of a promissory note, more than six years after it became due, said, that as there had been no money transactions between himself and the plaintiff previous to or during the year 1812, he was surprised at the demand; that he owed him nothing on the of account mentioned, and referred him to his final discharge under the act of 13th March, 1812, it was held, that the debt was barred by the act of limitations, notwithstanding the act of 1812, was unconstitutional and void. The operation of the act of limitations was not suspended, while the act of 13th March, 1812, "for the relief of insolvent debtors residing in the city and county of Philadelphia and their creditors," was held by the courts of this state to be constitutional and valid. In the District Court for the city and county of Philadelphia, a case was stated for the opinion of the court, which, for the purpose of a writ of error, was to be considered as a special verdict. It set forth the following facts. On the 17th of April, 1812, Edward Hudson, the defendant below, drew a promissory note in favour of Cornelius & Andrew Conrad, & Co. for 500 dollars, payable sixty days after date, which was indorsed by the payees to Mathew Carey, the plaintiff. On the 5th of September, 1812, the defendant obtained a certicate of discharge under the act of assembly of this state, passed the 13th of March, 1812, entitled "an act for the relief of insolvent debtors residing in the city and county of Philadelphia, and their creditors." On the 31st of March, 1817, the Supreme Court of the state of Pennsylvania, decided in the case of the Farmers' & Mechanics' Bank v. Smith, 3 Serg. & Rawle, 63, that the said act of assembly was constitutional; and upon a joinder in demurrer to the defendant's plea of a certificate of discharge under the said act, judgment was rendered for the defendant. That case having been removed, by writ of error to the Supreme Court of the United States, the said judgment was on the 13th February, 1821, reversed, on the ground that the said act of assembly of the 13th of March, 1812, was unconstitutional and void. And the parties agreed that each should be present when the purchase-money should be paid, and receive his own part. K. gave notice to the purchaser not to pay his money to 0. but to himself; that he was willing to take him (the purchaser) for it. The purchaser afterwards failed, and was unable to pay the money. In an action by K. against 0. on the single bill, it was held that he was not entitled to recover. Error to the Common Pleas of Armstrong county. This was an action of debt upon a bond, in which Michael Campbell and Charles Campbell, executors of Charles Campbell, deceased, were plaintiffs, and George Knox was defendant. The facts of the case appear so fully in the opinion of his honor, who delivered that of the court, that they need not be again stated. White and Stannard, for plaintiffs in error. The following is endorsed on the back of the above writing: "Accept the within order, and agree to pay over the same when collected, reserving my fees and percentage. The court below (Thompson, President) rendered a judgment for the defendant. Stephenson, for plaintiff in error. Pearson, for defendant in error. Per Curiam. - An equitable assignment is an agreement in the nature of a declaration of trust, which a chancellor, though deaf to the prayer of a volunteer, never hesitates to execute when it has been made on valuable, or even good consideration. Could there be a more explicit declaration than the order before us? Drum and Collins draw on their lawyer for the proceeds of an action against Hawkins, which they declare in the order to have been appropriated to payment of their note in the Warren Bank, on which Wheelen, the payee, was one of their sureties. If this appropriation was a condition of the contract of suretyship, it rested on a valuable consideration; if it was not, it rested on a good one, which is equally available. Drum and Collins were bound to secure Wheelen by putting funds into his hands to take up the paper at maturity, if they should not; and in giving this order they yielded to a moral obligation, which is a consideration for an express contract. The appropriation, then, being complete as an assignment of the fund by the agreement of the parties, even without the acceptance of the drawee, could not be revoked. Which was 101. The acre for the quantity mentioned in the patent. The valuation was confirmed by the Court, and by their de cree it was assigned to ffo/m, who gave security to pay their proportions to the rest of the family. William had several guardians subsequent to this decree, among whom were W'est, his brother, who acted until 1806, when 7ames Ross of Pittsburg' was appointed and continued during the minority. West received part of W'illiams' pro portion of the island. Mr. Ross received the residue, and on his coming of age, paid the balance due to him, and was exonerated from the trust.
