Book excerpt: This title was first published in 2000: The book analyses the development of arctic environmental cooperation since the late 1980s until the establishment of the Arctic Council in 1996. The study is based on the discourse analysis of statement, documents and interviews by the different actors in the cooperation. In this book, the problem of the environment is seen as a problem of order: it is a problem of ordering relations among related actors, of ordering priorities of action and of ordering relations between different institutional arrangements locally, regionally and internally. Three discourses were found in the cooperation: discourses of sovereignty, knowledge and development. In the discourse of sovereignty, the development of relations between state and indigenous peoples in terms of international environmental cooperation is central. In the discourse of knowledge, the different forms of knowledge and the role of different producers of knowledge in cooperation has been discussed. The discourse of development focuses on the idea of sustainable development and its applications in defining the future of the Circumpolar North and the activities of the Arctic Council. The arctic cooperation can be understood as a regional effort to make an order of sustainability into practice.

Interests now are awakening globally to take advantage of extensive energy, shipping, fishing and tourism opportunities in the Arctic Ocean as it is being transformed from a permanent sea-ice cap to a seasonally ice-free sea. This environmental state-change is introducing inherent risks of political, economic and cultural instabilities that are centralized among the Arctic states and indigenous peoples with repercussions globally. Responding with urgency, environmental security is presented as an "integrated approach for assessing and responding to the risks as well as the opportunities generated by an environmental state-change." In this book – diverse perspectives on environmental security in the Arctic Ocean are shared in chapters from high-level diplomats, parliamentarians and government officials of Arctic and non-Arctic states; leaders of Arctic indigenous peoples organizations; international law advisors from Arctic states as well as the United Nations; directors of inter-governmental organizations and non-governmental organizations; managers of multi-national corporations; political scientists, historians and economists; along with Earth system scientists and oceanographers. Building on the “common arctic issues” of “sustainable development and environmental protection” established by the Arctic Council – environmental security offers an holistic approach to assess opportunities and risks as well as develop infrastructure responses with law of the sea as the key “international legal framework” to “promote the peaceful uses” of the Arctic Ocean. With its varied populations, and with eight Nations asserting territorial interests, the Arctic needs a careful approach to its protection and development. This report describes the current Arctic environmental legal regime. It also discusses the possibility of negotiating a sustainability treaty for the Arctic with high standards of environmental protection similar to those in the 1991 Protocol on Environmental Protection to the Antarctic Treaty. It is hoped that this review of the legal and policy contrasts between the Arctic and Antarctic can help in the consideration of future directions for the Arctic legal regime.

Book excerpt: In this book, Sandra Engstrand uses role theory to study learning processes in environmental policy negotiations in the Arctic Council. Owing to rapid ice-melting in the Arctic region, and more accessible commercial opportunities, there is a greater need for environmental protection. However, large sections of the Arctic fall under state jurisdiction, often causing tensions to arise that prevent any cooperation from achieving fully efficient environmental protection. To enhance our understanding on how states learn about environmental norms, Engstrand examines negotiation processes on environmental protection for the prevention of Arctic marine oil spills and the reduction of short-lived climate pollutants. Through interviews with state representatives and through text analyses of nearly twenty years of meetings between Senior Arctic Officials from each of the eight Arctic states, Engstrand suggests that learning on environmental norms runs firstly through a learning of roles in international relations. She demonstrates how member states develop through self-reflection and by considering the expectation of others, concluding that states’ wishes to preserve their social role in a group and to be perceived as Arctic ‘cooperators’ are drivers for a social education on environmental norms. Unlike in the Antarctic, there is currently no single comprehensive legal regime for governance of the Arctic. Instead, the region is regulated by a patchwork of international treaties, above all the United Nations Convention on the Law of the Sea (UNCLOS), various regional and sub-regional agreements, national laws and soft-law agreements. This treatise provides an evaluation of the governance regime that regulates the use of the Arctic marine environment and its readiness to protect these fragile ecosystems in light of the consequences of climate change.
