Book The Optional Protocol to the UN Convention Against Torture

Download or read book The Optional Protocol to the UN Convention Against Torture written by Rachel Murray and published by OUP Oxford. This book was released on 2011-08-11 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Optional Protocol to the UN Convention Against Torture (OPCAT) establishes an independent international monitoring committee (SPT) which itself will visit states and places where persons are deprived of their liberty. It also requires states to set up independent national bodies to visit places of detention. This book, drawing upon events held and interviews with governments, civil society, members of UN treaty bodies, national visiting bodies and others, identifies key factors that have shaped the operation of these visiting bodies since OPCAT came into force in 2006. It looks in detail at the background to the adoption of the Protocol, as well as how the international committee, the SPT, has carried out its mandate in its first few years. It examines the range of places of detention that could be visited by these bodies, and the expectations placed on the national visiting bodies themselves. The book also places the OPCAT within the broader system of torture prevention in the UN and elsewhere and identifies a range of trends arising from the different geographical regions. As well as providing an insight into its work, this detailed examination of OPCAT also provides valuable lessons for other new human rights treaties such as the UN Convention on the Rights of Persons with Disabilities and the Convention on Enforced Disappearances, which have similar provisions concerning national mechanisms.

Book The Torture Doctors

Download or read book The Torture Doctors written by Steven H. Miles MD and published by Georgetown University Press. This book was released on 2020-03-02 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: Torture doctors invent and oversee techniques to inflict pain and suffering without leaving scars. Their knowledge of the body and its breaking points and their credible authority over death certificates and medical records make them powerful and elusive perpetrators of the crime of torture. In The Torture Doctors, Steven H. Miles fearlessly explores who these physicians are, what they do, how they escape justice, and what can be done to hold them accountable. At least one hundred countries employ torture doctors, including both dictatorships and democracies. While torture doctors mostly act with impunity—protected by governments, medical associations, and licensing boards—Miles shows that a movement has begun to hold these doctors accountable and to return them to their proper role as promoters of health and human rights. Miles’s groundbreaking portrayal exposes the thinking and psychology of these doctors, and his investigation points to how the international human rights community and the medical community can come together to end these atrocities.

Book Analysis of implementation of the recommendations on the penitentiary system provided to Ukraine by the European Committee for the Prevention of Torture since 1998

Download or read book Analysis of implementation of the recommendations on the penitentiary system provided to Ukraine by the European Committee for the Prevention of Torture since 1998 written by Vadym Chovgan and published by Човган Вадим Олександрович. This book was released on 2020-08-25 with total page 84 pages. Available in PDF, EPUB and Kindle. Book excerpt: This analysis is devoted to the progress in implementation of the recommendations made by the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (hereinafter – CPT, Committee). It concerns all the recommendations made by the Committee since its first visit to Ukraine in 1998. During this time, the Committee has published 15 reports pertaining to Ukraine. Of these, 12 reports that were fully or partially devoted to the Ukrainian penitentiary system were analysed. Three remaining reports were ignored since they were dealing exclusively with other areas (psychiatric institutions, border guard facilities, etc.). The intention was to analyse the implementation progress of only those recommendations, the implementation of which could be measured. Besides, only recommendations of systemic nature were taken for analysis. Therefore, the analysis does not consider the implementation of other recommendations with regard to: individual penitentiary institutions and their repair state; individual or collective cases of torture/degrading treatment in certain institutions; provision of material resources, food, medicines, etc .; staffing level of individual institutions. Thus, the focus was on recommendations with regard to which it was possible to state on their implementation, non-implementation or partial implementation. An important part of these recommendations require legislative changes and/or additional funding. In some cases, recommendations for individual institutions were taken into account when addressing systemic issues. The purpose of the analysis was to conduct a kind of "inventory" of the Committee's outstanding recommendations. The idea was to summarize a large number of standards scattered in the various reports. To facilitate finding the referenced reports containing relevant recommendations the year of the Committee's visit and the paragraph of the relevant report are indicated in parentheses.
