The ultimate limitation period found under section 8 of the Limitation Act was introduced into the Act in 1975 and sets an outside time limit within which claims must be brought before the courts. This report embodies the recommendations of the British Columbia Law Institute in relation to section 8 of the Limitation Act. The principal recommendation is that the 30-year ultimate limitation period of general application is far too long as a default rule and should be reduced to 10 years. It is also recommended that the running of time under the proposed ultimate limitation period should commence from the date of the act or omission that constitutes a breach of duty. These recommendations will require consequential revisions to section 8 which are described in the body of the report.

Book excerpt: Extinctive Prescription / On the Limitation of Actions contains sixteen national reports and the general report on the subject, written for the XIVth Congress of the International Academy of Comparative Law, held from 31 July-August, 1994, in Athens, Greece. The volume deals with limitations of actions, or `extinctive prescription', as the subject is usually called in civil law jurisdictions. This is both a highly technical and a highly political topic. The book focuses on the political aspects of extinctive prescription; specifically, how long should prescription periods run, as of what event, interrupted by which circumstances, etc. The trend in modern legislation has been to shorten the periods of extinctive prescription. Recent occurrences in biology and medicine, however, have led to proposals to lengthen the limitation periods again. The reports discuss the situation in Europe, Latin America, and North America, and are especially interesting because of their comparative nature.

In the Limitations report, the Commission identified what it saw as the primary areas of Manitoba limitations law requiring modernization, and the best ways of accomplishing that goal. The Commission recommended the abolition of various categories of claims and favoured a single, basic two-year limitation from the date of discovery, applicable to all claims unless they are otherwise dealt with in the new Act. The Commission also recommended an ultimate 15-year limitation period running from the day on which the act or omission on which the claim is based took place, beyond which no claim may be brought. This system, designed around a single basic two-year limitation period and a 15-year ultimate limitation period, will be referred to in this report as the "standard limitation regime".
