Book excerpt: The Department of the Environment's Driver and Vehicle Agency (the Agency) is responsibility for conducting vehicle tests. By the mid-1990s, the Agency's vehicle testing equipment was outdated and increasingly prone to breakdown. In March 2001, it signed a Private Finance Initiative (PFI) contract costing £57 million for the design, finance and build of 61 computerised test lanes at its 15 test centres. Vehicle tests were meant to take no longer than an average of 18 minutes and customer waiting times for tests must not exceed an average of 14 days. However, the Agency experienced serious problems and its customers were subject to excessive and unacceptable waiting times, particularly in the early years of the contract. Recent improved performance has come at a financial cost. Overall costs are some £6 million higher than if the contracted test times had been delivered, a cost borne exclusively by the Agency's customers. The contract has failed to assign risks in a transparent and appropriate basis and it has proven difficult to determine liability for the failure to deliver the 18 minute test time. The Agency's position has not been helped by its own poor management of the contract. It took almost two years to collect the basic management information essential for performance monitoring. In addition, the Agency consistently failed to provide the level of staffing required by the contract and has a complete lack of knowledge about how profitable this deal has been to the contractor. In the Committee's view there has been too little done by the Agency to resolve its contractual difficulties and it has taken much longer than it should have to initiate the planned performance review.

Book excerpt: In Northern Ireland vehicle tests (MOTs) are conducted within the public sector by the Driver & Vehicle Testing Agency (DVTA). This report examines the £57million contract for the provision of automated vehicle testing equipment, procured under the Private Finance Initiative. The contract was signed in March 2001 and required the contractor to design, finance and build 61 computerised and calibrated test lanes at DVTAs 15 test centres between 2001 and 2003, and maintain them for 15 years thereafter. DVTAs vehicle examiners are responsible for operating the equipment. DVTA has consistently been unable to achieve the key performance indicators specified in the contract, and average vehicle test times have been five minutes above the 18-minute PFI target. Average waiting times for customers rose from 20 calendar days in 2002-03 to 55 calendar days in 2004-05. This has resulted in unplanned overtime, and the situation has been complicated by a shortage of examiners. Full emissions testing in accordance with EU requirements, intruduced on 1 March, could result in tests increasing to between 25 and 29 minutes. Such an outcome would result in capacity becoming exhausted in some test centres as early as 2006-07, and at 10 of the 15 centres by 2010-11. A move to a 27-minute booking slot may increase costs by £33.3 million. If DVTA is unable to determine the reasons for the variable productivity across its test centres, it is unlikely that it will be able to demonstrate that the contractors bear any liability for the failure to achieve the 18-minute test. Consequently, it will be poorly placed to implement deductions from annual payments to the contractors and will also be unable to terminate the contract. DVTA would then be faced with the likelihood of having to fund the significant costs of providing additional capacity, and having to increase test fees accordingly.
