Available in PDF, EPUB and Kindle. Book excerpt: Rosemary Nelson, a solicitor in Lurgan, Northern Ireland, was murdered by a bomb exploding under her car near her home in March 1999. There were claims the police and government ignored a series of warnings about threats against her: concerns about her safety had been raised over a two-year period before she was killed. She had become a hate figure for hardline loyalists - and reportedly some police officers - because of some of the Republican clients she represented. It was claimed she had been threatened by RUC officers as well as loyalist paramilitaries. The Cory Collusion Inquiry (2004, ISBN 9780102927443) investigated the allegations of collusion between British security forces and paramilitaries in her murder, and concluded that there was enough evidence to warrant a full public inquiry. This Inquiry finds no evidence of any act by or within any of the state agencies (Royal Ulster Constabulary, the Northern Ireland Office or the Security Service) which directly facilitated the murder. Some members of the RUC did publicly abuse and assault her in 1997, and make abusive/threatening remarks about her to her clients, which became publicly known. Combined with intelligence leaks these had the effect of legitimising her as a target. There were omissions by the RUC and NIO which rendered her more at risk and more vulnerable. These omissions meant the state failed to take reasonable and proportionate steps to safeguard the life of Rosemary Nelson. The Inquiry finds no evidence of obstruction into the murder investigation, which was carried out with due diligence.

It is the foremost international human rights norm protecting persons from attacks on their dignity and integrity. Consequently, it has been at the forefront of a series of developments in international human rights law and international law more broadly. Having withstood sustained challenges to its absolute nature in the 'war on terror', it has broadened its scope of application, becoming more sophisticated and complex in the process. The prohibition of torture increasingly interacts with other fields of human rights law, such as non-discrimination law, international criminal law, international humanitarian law, and international migration law. The Transformation of the Prohibition of Torture in International Law analyses the nature and significance of this transformation and looks into the scope of the prohibition's further evolution. Empirical scholarship, innovative human rights body practice, and challenges from activists, particularly from the Global South, have focused on the relational nature of torture and other ill-treatment, its embeddedness in wider structures of power, and the role of international law in legitimizing-if not facilitating-widespread suffering, from mass incarceration to poverty and climate change. This analysis reveals an inherent tension in the prohibition between a conventional, narrow focus on direct State violence and a wide lens encompassing myriad forms of suffering. In July 2010, Wikileaks published Cablegate, one of the biggest leaks in the history of the US military, including evidence for war crimes and torture. In the aftermath Julian Assange, the founder and spokesman of Wikileaks, found himself at the center of a media storm, accused of hacking and later sexual assault. At this point, Nils Melzer, UN Special Rapporteur on Torture, started his investigation into how the US and UK governments were working together to ensure a conviction. His findings are explosive, revealing that Assange has faced grave and systematic due process violations, judicial bias, collusion and manipulated evidence. He has been the victim of constant surveillance, defamation and threats. Melzer also gathered together consolidated medical evidence that proves that Assange has suffered prolonged psychological torture. Melzer’s compelling investigation puts the UK and US state into the dock, showing how, through secrecy, impunity and, crucially, public indifference, unchecked power reveals a deeply undemocratic system. Furthermore, the Assange case sets a dangerous precedent: once telling the truth becomes a crime, censorship and tyranny will inevitably follow. The Trial of Julian Assange is told in three parts: the first explores Nils Melzer’s own story about how he became involved in the case and why Assange’s case falls under his mandate as the Special Rapporteur on Torture. The second section returns to 2010 when Wikileaks released the largest leak in the history of the U.S. military, exposing war crimes and corruption, and Nils makes the case that Swedish authorities manipulated charges against Assange to force his extradition to the US and publicly discredit him. In the third section, the author returns to 2019 and picks up the case as Ecuador kicks Assange out of the embassy and lays out the case as it currently stands, as well as the stakes involved for other potential whistleblowers trying to serve the public interest.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.
