Book excerpt: The Committee on the Programme for Government was set up in November 2006 to consider the priorities for a new Northern Ireland Executive and to make preparations for its restoration. This report give the results and proceedings of a Sub-Group of the Committee, covering policing and justice issues. However, the Subgroup was unable to reach consensus on the matters of ministerial arrangements, appointment procedure, the timing of devolution. The Subgroup did agree that all parties should support the rule of law. Members considered all the matters for devolution as laid out in a Northern Ireland Office discussion paper, and concluded, in principle, that all should be devolved. The parties disagreed regarding the degree to which some presently preserved and excepted matters should be devolved.

This book, newly available in paperback, analyses truth recovery as a fundamental aspect of the transition from political violence to peace, democracy and stability in post-conflict Northern Ireland. Kirk Simpson argues that it is essential for any process of truth recovery in Northern Ireland to provide the victims of political violence with the opportunity to express and articulate their narratives of suffering within the context of public dialogic processes. He outlines a unique and original model: that victims of political violence should be enabled to engage in meaningful truth recovery through a Habermasian process of public democratic deliberation and communication involving direct dialogue with the perpetrators of such violence. This process of ‘communicative justice’ is framed within Habermas’s theory of communicative action and can help to ensure that legitimate truth recovery publicly acknowledges the trauma of victims and subjects perpetrator narratives of political violence to critical scrutiny and rational deconstruction. Crucially, the book aims to contribute to the empowerment of victims in Northern Ireland by stimulating constructive discussion and awareness of hitherto silenced narratives of the conflict. Book excerpt: The Committee recognises the commitment and effort of individual HMRC officers in the fight against fuel crime in Northern Ireland, but says that as HMRC was allocated an additional £917 million in 2010-11 to bear down on tax avoidance and evasion across the UK, it should make a more concerted effort to eradicate the problem in Northern Ireland, where it is most prevalent. There is particular disappointment in the lack of progress on developing new "markers": chemicals added to fuel to mark it out as rebated, which are removed to enable it to be fraudulently sold at higher prices. Northern Ireland is estimated to have lost £70 million in 2009-10. Only five years ago this figure was as high as £250 million but fuel fraud remains a particularly serious problem for Northern Ireland. While 4% of diesel sold in GB is thought to be illicit, in Northern Ireland the comparable figure is estimated to be 12%. District councils in Northern Ireland foot the bill for cleaning up the harmful wastes left by laundering - about £330,000 in the last five years. The problem is also particularly acute in Northern Ireland because of links between organised criminal gangs and paramilitaries. The Committee is concerned at the apparent limited success of assets recovery as a deterrent. This lack of deterrence is exacerbated by the poor record for imposing custodial sentences in Northern Ireland. Between 2001 and 2009, only four people received custodial sentences for fuel fraud in Northern Ireland

Book excerpt: Our thesis is that policing in the mid-1980s was perceived to be in crisis and there was a strong sense that fundamental changes were needed in the way it was delivered. In contrast, police are considered to be performing well 20 years later by both practitioners and outside observers. Crime has been falling for almost 18 years and any new challenges, including terrorism, appear to be manageable without the invention of new strategies for the delivery of police services. Past experience contains the lessons needed for the future. In our view, this assessment may be mistaken, not because existing policies are defective in controlling crime but because the institutions that provide public safety are changing in profound ways that are not being recognized.
