Book The Making of Consumer Law and Policy in Europe

Download or read book The Making of Consumer Law and Policy in Europe written by Hans-W Micklitz and published by Bloomsbury Publishing. This book was released on 2021-11-04 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the founding years of consumer law and consumer policy in Europe. It combines two dimensions: the making of national consumer law and the making of European consumer law, and how both are intertwined. The chapters on Germany, Italy, the Nordic countries and the United Kingdom serve to explain the economic and the political background which led to different legal and policy approaches in the then old Member States from the 1960s onwards. The chapter on Poland adds a different layer, the one of a former socialist country with its own consumer law and how joining the EU affected consumer law at the national level. The making of European consumer law started in the 1970s rather cautiously, but gradually the European Commission took an ever stronger position in promoting not only European consumer law but also in supporting the building of the European Consumer Organisation (BEUC), the umbrella organisation of the national consumer bodies. The book unites the early protagonists who were involved in the making of consumer law in Europe: Guido Alpa, Ludwig Krämer, Ewa Letowska, Hans-W Micklitz, Klaus Tonner, Iain Ramsay, and Thomas Wilhelmsson, supported by the younger generation Aneta Wiewiórowska Domagalska, Mateusz Grochowski, and Koen Docter, who reconstructs the history of BEUC. Niklas Olsen and Thomas Roethe analyse the construction of this policy field from a historical and sociological perspective. This book offers a unique opportunity to understand a legal and political field, that of consumer law and policy, which plays a fundamental role in our contemporary societies.

Book European Union Enlargement

Download or read book European Union Enlargement written by Jurgen Elvert and published by Routledge. This book was released on 2004-08-02 with total page 275 pages. Available in PDF, EPUB and Kindle. Book excerpt: European Union Enlargement provides a comparative analysis of the post-war European policies of those states that joined the European Union between 1973 and 1995. The volume draws upon new empirical research in order to investigate the policies that these 'newcomer' states have had towards Europe since 1945, with an emphasis on their experience of membership and its possible Europeanising effect. A final comparative chapter draws the national European policies of the 'newcomers' together and outlines what they have brought to the EU. The book also tests integration theories against the available evidence, demonstrating their limited explanatory value and the economic, political and cultural specificity of different national paths towards EU integration.

Book The Emergence of Personal Data Protection as a Fundamental Right of the EU

Download or read book The Emergence of Personal Data Protection as a Fundamental Right of the EU written by Gloria González Fuster and published by Springer Science & Business. This book was released on 2014-04-28 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the coming into being in European Union (EU) law of the fundamental right to personal data protection. Approaching legal evolution through the lens of law as text, it unearths the steps that led to the emergence of this new right. It throws light on the right’s significance, and reveals the intricacies of its relationship with privacy. The right to personal data protection is now officially recognised as an EU fundamental right. As such, it is expected to play a critical role in the future European personal data protection legal landscape, seemingly displacing the right to privacy. This volume is based on the premise that an accurate understanding of the right’s emergence is crucial to ensure its correct interpretation and development. Key questions addressed include: How did the new right surface in EU law? How could the EU Charter of Fundamental Rights claim to render ‘more visible’ an invisible right? And how did EU law allow for the creation of a new right while ensuring consistency with existing legal instruments and case law? The book first investigates the roots of personal data protection, studying the redefinition of privacy in the United States in the 1960s, as well as pioneering developments in European countries and in international organisations. It then analyses the EU’s involvement since the 1970s up to the introduction of legislative proposals in 2012. It grants particular attention to changes triggered in law by language and, specifically, by the coexistence of languages and legal systems that determine meaning in EU law. Embracing simultaneously EU law’s multilingualism and the challenging notion of the untranslatability of words, this work opens up an inspiring way of understanding legal change. This book will appeal to legal scholars, policy makers, legal practitioners, privacy and personal data protection activists, and philosophers of law, as well as, more generally, anyone interested in how law works.

Book The Human Rights Breakthrough of the 1970s

Download or read book The Human Rights Breakthrough of the 1970s written by Sara Lorenzini and published by Bloomsbury Publishing. This book was released on 2021-12-16 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: During the 1970s human rights took the front stage in international relations; fuelling political debates, social activism and a reconceptualising of both East-West and North-South relations. Nowhere was the debate on human rights more intense than in Western Europe, where human rights discourses intertwined the Cold War and the European Convention on Human Rights, the legacies of European empires, and the construction of national welfare systems. Over time, the European Community (EC) began incorporating human rights into its international activity, with the ambitious political will to prove that the Community was a global “civilian power.” This book brings together the growing scholarship on human rights during the 1970s, the history of European integration and the study of Western European supranational cooperation. Examining the role of human rights in EC activities in Latin America, Africa, the Mediterranean, Eastern Europe and the Soviet Union, The Human Rights Breakthrough of the 1970s seeks to verify whether a specifically European approach to human rights existed, and asks whether there was a distinctive 'European voice' in the human rights surge of the 1970s.
