Book excerpt: Workers who loaded and unloaded ships have formed a distinctive occupational group over the past two centuries. As trade expanded so the numbers of dock labourers increased and became concentrated in the major ports of the world. This ambitious two-volume project goes beyond existing individual studies of dock workers to develop a genuinely comparative international perspective over a long historical period. Volume 1 contains studies of 22 major ports worldwide. Built around an agreed framework of issues, these 'port studies' examine the type of workers who dominated dock labour, their race, class and ethnicity, the working conditions of dockers and the role of government as employer, arbitrator and supporter. The studies also detail how dockers organized their labour, patterns of strike action and involvement in political organizations. The structure of the port city is also outlined and descriptions given of the waterside environment. These areas of investigation form the basis for a series of 11 thematic studies which comprise Volume 2. Drawing on the information provided in the port studies, these essays identify important aspects and recurring themes, and explain how and why particular cases diverge from the rest. The final chapter of the book synthesizes the various approaches taken to offer a model which suggests several configurations of dock labour and presents suggestions for future research. This major scholarly achievement represents the most sustained attempt to date to provide a comparative international history of dock labour. An annotated bibliography completes this essential reference work.

Book Masters Servants and Magistrates in Britain and the Empire 1562 1955

Download or read book Masters Servants and Magistrates in Britain and the Empire 1562 1955 written by Douglas Hay and published by Univ of North Carolina Press. This book was released on 2005-10-12 with total page 607 pages. Available in PDF, EPUB and Kindle. Book excerpt: Master and servant acts, the cornerstone of English employment law for more than four hundred years, gave largely unsupervised, inferior magistrates wide discretion over employment relations, including the power to whip, fine, and imprison men, women, and children for breach of private contracts with their employers. The English model was adopted, modified, and reinvented in more than a thousand colonial statutes and ordinances regulating the recruitment, retention, and discipline of workers in shops, mines, and factories; on farms, in forests, and on plantations; and at sea. This collection presents the first integrated comparative account of employment law, its enforcement, and its importance throughout the British Empire. Sweeping in its geographic and temporal scope, this volume tests the relationship between enacted law and enforced law in varied settings, with different social and racial structures, different economies, and different constitutional relationships to Britain. Investigations of the enforcement of master and servant law in England, the British Caribbean, India, Africa, Hong Kong, Canada, Australia, and colonial America shed new light on the nature of law and legal institutions, the role of inferior courts in compelling performance, and the definition of "free labor" within a multiracial empire. Book Productivity and Discipline Victims of Misdirected Social Justice

Download or read book Productivity and Discipline Victims of Misdirected Social Justice written by and published by KW Publishers Pvt Ltd. This book was released on 2014-12-15 with total page 157 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book of its kind in which an attempt has been made to brain-scan some of the judgments of the Supreme Court as well as of various high courts and then to link up the results with the objectives of planned development as enumerated in successive Five-Year Plans. The results of this clinical experiment reveal that the entire Industrial Jurisprudence evolved thus far is based on the concepts of Social Justice, Industrial Peace and Job Security. But in practice, Social Justice has promoted inequality, Industrial Peace has failed to accelerate productive activities of the country for the benefit of the community, and Job Security has promoted indiscipline and inefficiency. There is a powerful appeal to the judiciary as a class, the Bar as a profession, the Government as an instrument, and the political echelons as power-wielders to re-examine the total approach and link up industrial jurisprudence with the objectives of planned development. It is contended in the book that wherever a judgment or award is pronounced on the grounds of Social Justice, judges and adjudicators have a duty to show that the interests of the community were borne in mind. They must remember that industrial peace is treated as relevant because it leads to more production and thereby has a healthy impact on the national economy. Job Security is treated as relevant because it would promote efficiency and discipline. In their zest to fight for their respective claims, employers and employees may choose to ignore the demand of national economy, but the judiciary cannot. At the first blush the book may appear to take sides between employers and employees, but once the concepts of Social Justice, Industrial Peace and Job Security are understood with reference to what actually happened during the last 65 years, it is bound to receive wide support and acceptance in all circles. In this edition two chapters have been added viz. Misconducts, Punishments Other Miscellaneous issues – shift from judicial activism to restraint and Judicial Discipline.
