This book provides a comprehensive, up to date and critical overview of the youth justice system, taking full account of the many changes that have been introduced - in particular the Crime and Disorder Act 1998 and its subsequent implementation. A major aim of the book will be to help youth justice practitioners and others studying youth crime and youth justice to make sense of these changes, to assess their implications for practice and to understand some of the tensions and complexities that have arisen. The book begins by setting the youth justice system in its broader historical and contemporary context, moving on to assess the impact of political ideologies on the structures (such as the Youth Justice Board and Youth Offending Teams) and processes (including anti-social behaviour strategies, restorative justice and more intensive community interventions). which compromise youth justice as it is currently delivered. The book goes on to argue that the failings of current policy, organisational frameworks and delivery mechanisms have had a cumulative and damaging effect, resulting in an over-reliance on intrusive, oppressive and counter-productive measures of control.Against this backdrop, the book explores some of the unerlying theoretical issues concerning young people and crime, and then sets out some of the principles which should underpin positive policies and practice with young people in trouble. Finally, it draws together some of the evidence from current initiatives, domestically and internationally, to suggest that it remains possible both to envision and to deliver a youth justice system which is liberal, humane and progressive.

Book excerpt: This report sets out the findings of the public inquiry into the murder in March 2000 at Feltham Young Offender Institution of Zahid Mubarek, an Asian teenager. Mubarek died after being attacked by another young prisoner, his cellmate Robert Stewart, who had a history of violence and racist behaviour. The report identifies the systemic shortcomings which the attack exposed and makes 88 recommendations to reduce the risk of such an attack in the future. Issues discussed include: the events leading up to the public inquiry, including previous investigations by the Prison Service and the Commission for Racial Equality; the mental health background and custodial history of Stewart; the events on the night of the attack; and the wider ongoing problems at Feltham of staff shortages and low staff morale, lack of resources and overcrowding; poor working practices and evidence of racism by staff and prisoners. Recommendations made include: the elimination of enforced cell-sharing should be a high priority for the Prison Service and it should publish guidelines to assist officers in the allocation of prisoners who have to share a cell, taking into account issues of ethnic and religious background; there should be a general rule that an unconvicted prisoner should not share a cell with a convicted prisoner; full cell searches should be carried out at least once every three months; prisoner councils should be set up as part of violence reduction strategies in prisons; improved diversity training for prison staff; and the need for a national database for security information on prisoners to improve the flow of information between and within establishments to help prisoner risk assessment procedures.

Book excerpt: 96 women, men and children died as a result of the disaster in Hillsborough Stadium on 15 April 1989. They were crushed due to overcrowding in the Leppings Lane terrace, penned in by the ground's fencing. Hundreds more were injured and thousands traumatised. Lord Justice Taylor led a judicial inquiry (1990, Cm. 962, ISBN 9780101096225), concluding that the main cause of the disaster was the failure of police control. The next 11 years saw a variety of investigations and proceedings, including a scrutiny of new evidence (Lord Justice Stuart-Smith, 1998, Cm. 3878, ISBN 9780101387828). Yet many bereaved families felt that the true context, circumstances and aftermath had not been adequately made public, and were particularly aggrieved that it had become widely assumed that Liverpool fans' behaviour had contributed to the disaster. The Independent Panel was established in 2010 to oversee full public disclosure of all documents relating to the disaster and to report on its work. This report is in three parts. Firstly it shows what was already known and in the public domain by 2010. Secondly, in 12 detailed chapters, it describes what the disclosed documents add to public understanding. The third part gives a review of options for providing an archive of the documents. The disclosed documents (available at http://panel.hillsborough.independent.gov.uk/) add considerably to public understanding. They show that multiple factors were responsible for the tragedy and that the fans were not the cause. The report also shows that the bereaved families met a series of obstacles in their search for justice over more than 20 years.
