This book offers a detailed discussion of the important issues in environmental law, policy, and economics, tracing their development over the past few decades through an examination of environmental law cases and commentaries by leading scholars. The authors focus on pollution, addressing both pollution control and prevention, but also emphasize the evaluation, design, and use of the law to stimulate technical change and industrial transformation, arguing that there is a need to address broader issues of sustainable development. Environmental Law, Policy, and Economics,which grew out of courses taught by the authors at MIT, treats the traditional topics covered in most classes in environmental law and policy, including common law and administrative law concepts and the primary federal legislation. But it goes beyond these to address topics not often found in a single volume: the information-based obligations of industry, enforcement of environmental law, market-based and voluntary alternatives to traditional regulation, risk assessment, environmental economics, and technological innovation and diffusion. Countering arguments found in other texts that government should play a reduced role in environmental protection, this book argues that clear, stringent legal requirements--coupled with flexible means for meeting them--and meaningful stakeholder participation are necessary for bringing about environmental improvements and technologicial transformations.

Book excerpt: While many recent observers have accused American judges—especially Supreme Court justices—of being too driven by politics and ideology, others have argued that judges are justified in using their positions to advance personal views. Advocating a different approach—one that eschews ideology but still values personal perspective—H. Jefferson Powell makes a compelling case for the centrality of individual conscience in constitutional decision making. Powell argues that almost every controversial decision has more than one constitutionally defensible resolution. In such cases, he goes on to contend, the language and ideals of the Constitution require judges to decide in good faith, exercising what Powell calls the constitutional virtues: candor, intellectual honesty, humility about the limits of constitutional adjudication, and willingness to admit that they do not have all the answers. Constitutional Conscience concludes that the need for these qualities in judges—as well as lawyers and citizens—is implicit in our constitutional practices, and that without them judicial review would forfeit both its own integrity and the credibility of the courts themselves.

Having been connected with every department of the game from player to magnate, Mr. Spalding has contributed a very important work to the game's history. As the invincible pitcher of the Boston Club, previous to the formation of the National League, his book of so many pages is an interesting record of events dating from the beginning of the great American pastime. It is not exactly a history of the game, but deals largely with incidents during the author's career, who was a player in the late 1860s and early 1870s, and helped organize the National League in 1876. One chapter, devoted to sundry topics, gives an account of the sale of the immortal "King Kelly," the original "$10,000 beauty," by Chicago to the Boston Club in the late 1880s. Other Chapters are devoted to the literature of the game, quoting several instances of the baseball paragrapher's art and also specimens of the distinct poetry of the pastime, of which "Casey at the Bat" is probably the most widely known. The Cincinnati Red Stockings Mr. Spalding gives credit as being the pioneer professional organization. It was not, however, until 1871 that professional baseball playing, as recognized today, was instituted. Mr. Spalding shows how cricket could not do for Americans. He says it is suitable for the British temperament, but not for the Yankee hustling spirit. He also tells how he worked into the game through a one-handed catch when a small boy. To lovers of baseball, whose name is legion, and whose number increases yearly, this book comprises in itself a whole library of useful information.
