Download or read book Humanizing the Laws of War written by Richard Baxter and published by OUP Oxford. This book was released on 2013-08-01 with total page 389 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book celebrates the scholarship of Richard Baxter, former Judge of the International Court of Justice and former Professor of International Law at Harvard Law School. The volume brings together Professor Baxter's writings on the laws of war, on which he was one of the most influential scholars of the twentieth century. The collection of essays contained in this book once again makes his exceptional writings available to scholars and students in the field. His work remains timely and relevant to today's issues, and offers many analyses which have been borne out in subsequent years. It includes, amongst many wide-ranging topics within the laws of war, Baxter's studies of the Geneva Conventions, human rights in times of war, and the legal problems of international military command. Featuring a new introduction by Professor Detlev Vagts exploring the importance of Baxter's writings, and a Biographical Note by Judge Stephen Schwebel assessing Baxter's life, this book is essential reading for scholars and students of international humanitarian law.

Download or read book The League of Nations and the Organization of Peace written by Martyn Housden and published by Routledge. This book was released on 2014-07-22 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: The League of Nations - pre-cursor to the United Nations - was founded in 1919 as a response to the First World War to ensure collective security and prevent the outbreak of future wars. It was set up to facilitate diplomacy in the face of future international conflict, but also to work towards eradicating the very causes of war by promoting social and economic justice. The philosophy behind much of the League's fascinating and varied roles was to help create satisfied populations who would reject future threats to the peace of their world. In this new volume for Seminar Studies, Martyn Housden sets out to balance the League's work in settling disputes, international security and disarmament with an analysis of its achievements in social and economic fields. He explores the individual contributions of founding members of the League, such as Fridtjof Nansen, Ludwik Rajchman, Rachel Crowdy, Robert Cecil and Jan Smuts, whose humanitarian work laid the foundations for the later successes of the United Nations in such areas as: the welfare of vulnerable people, especially prisoners of war and refugees dealing with epidemic diseases and promoting good health anti-drugs campaigns Supported by previously unpublished documents and photographs, this book illustrates how an understanding of the League of Nations, its achievements and its ultimate failure to stop the Second World War, is central to our understanding of diplomacy and international relations in the Inter-War period.

Download or read book Belligerent Reprisals written by Frits Kalshoven and published by BRILL. This book was released on 2005-06-01 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: Belligerent Reprisals examines the historical developments in the law and practice relating to recourse to belligerent reprisals, as a (primitive) means of law enforcement in the hands of a party to an armed conflict, victim of a violation of the law of war at the hands of its enemy. As a legal concept, the notion means that the victim in turn violates a rule of the same body of the law of war, with the purpose of thus inducing the enemy to terminate its unlawful conduct. However, the enemy may in its turn denounce the so-called reprisal as an unlawful act of war and retaliate against it, thus setting in motion the ill-famed spiral of negative reciprocity. While early lawmakers refrained from taking up the issue, prohibitions of reprisals could be achieved in conventions adopted in 1929 and 1949 on the protection of the power of the enemy. In contrast, reprisals (or retaliatory conduct announced under that title without meeting the requisite conditions) were common practice in the conduct of hostilities, with civilians in non-occupied territory as the main victims. With major governments disinclined to give up this tool, the ban on reprisals against civilian populations ultimately accepted in the Protocols of 1977 Additional to the Geneva Conventions of 1949 could only be hard-fought, and it remains contested to this day. First published in 1971, Belligerent Reprisals has become a classic work on this complex topic. The analysis of lawmaking and state practice it contains is as valid today as it was in the late 1970’s, and elucidates the dilemmas inherent in the notion of belligerent reprisal, as a means of law enforcement that can go terribly wrong.
