Download or read book Counter terrorism Constitutionalism and Miscarriages of Justice written by Genevieve Lennon and published by Bloomsbury Publishing. This book was released on 2018-11-01 with total page 530 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this book is to honour the influential and wide-ranging work of Professor Clive Walker. It explores Professor Walker's influence from three perspectives. Firstly, it provides a historical reflection upon the development of the law and policy in relation to counter-terrorism and miscarriages of justice since the 1970s. This historical perspective, which is often overlooked, is particularly timely 17 years after 9/11 as trends become clearer and historical perspective even more valuable. So too with miscarriages of justice: while there was considerable public and political scrutiny following high-profile miscarriages such as the Birmingham Six, Guildford Four, and others, in the early 1990s, today there is much less scrutiny, despite significant concern relating to issues such as legal aid and access to justice increasing the potential (if not likelihood) for miscarriages to occur. By including a critical historical perspective, this book enables us to learn lessons from the past and to minimise contemporary risks of miscarriages of justice. Secondly, this book provides a critical analysis of the law and policy as it stands today, and its future trajectory. Applying Walker's theoretical and analytical contributions to the field, the authors focus on pressing contemporary concerns, identifying lacunae where relevant, as well as the possible, probable and preferable future trends. Finally, the book celebrates and recognises the significant contributions by Walker, with each chapter built around one or more of Walker's key works.
Download or read book Terrorism and the Law written by Clive Walker and published by Oxford University Press. This book was released on 2011-03-03 with total page 629 pages. Available in PDF, EPUB and Kindle. Book excerpt: Terrorism law and legal practice has been politically and socially controversial to a degree beyond almost any other legal issue during the past few years, and this analytical text contains extensive analysis of these controversies. Terrorism and the Law offers a thoughtful and up-to-date discussion of all the key materials on terrorism law. It provides comprehensive coverage of all the major domestic, European, and international laws, and their impact on the UK. It also contains an extensive examination of the implementation of these terrorism laws, and of the practical issues they raise. The book contains three Parts. Part I focuses on meanings of 'terrorism' in law and political science. It provides the reader with an understanding of the phenomenon and the legal concept, including its statutory definitions, which is essential to the book's assessment of the strategies and tactics adopted in the codes of laws. It also covers normative constraints, such as human rights. Part II focuses on the United Kingdom law. It provides extensive coverage of the major UK terrorism legislation, such as: the Terrorism Act 2000; the Anti-Terrorism, Crime and Security Act 2001; the Prevention of Terrorism Act 2005; the Terrorism Act 2006; the Terrorism (Northern Ireland) Act 2006; the Justice and Security (Northern Ireland) Act 2007; and the Counter-Terrorism Act 2008. It also examines the key laws and rules relating to terrorism policing and legal processes. It discusses the meaning of these legislative materials, as well as their implementation, and includes reference to case law and practice statements from the police and courts. Part III reflects the impact of European, international and transnational laws and practices, covering international transnational cooperation and extradition, key European Union law measures against terrorism, other international law measures against terrorist activities, and international human rights and terrorism.
Download or read book Legal Challenges to the Far Right written by Natalie Alkiviadou and published by Routledge. This book was released on 2019-11-22 with total page 139 pages. Available in PDF, EPUB and Kindle. Book excerpt: The work considers the international and European obligations of the UK in the realm of challenging the far-right and assesses the extent to which it adheres to them. It looks at the role of criminal law in tackling hate speech and hate crime and assesses how English law deals with political parties which may deviate from agreed norms and principles such as non-discrimination. The legal analysis is placed within a contextual framework of far-right parties in the United Kingdom and also incorporates a definitional framework in terms of how the law defines themes relevant to challenging the far-right, such as racial discrimination, terrorism and extremism. The book presents a valuable guide for students, academics and policy-makers in the areas of International Human Rights Law, Criminal Law, Comparative Constitutional Law, National Security Law, Comparative Politics and Terrorism Studies.
Download or read book The Legacy of 9 11 written by Ryan Shaffer and published by Taylor & Francis. This book was released on 2024-06-14 with total page 130 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Legacy of 9/11 is a retrospective about how policing, intelligence, and counter-terrorism have changed in the more than twenty years since the September 11, 2001 terrorist attacks. Bringing together scholars and practitioners, the book takes an interdisciplinary approach with fields including history, international relations, intelligence studies, law, and political science. It highlights how some challenges in policing, intelligence, and counter-terrorism brought about by the attacks have been resolved, how some persist and how others have been transformed. The chapters explore state and non-state actors’ actions, reactions, and overreactions that shape contemporary aspects of policing, intelligence, and terrorism. In all three worlds, intelligence, policing, and counter-terrorism, the 9/11 attacks changed how the threat of terrorism is perceived, approached, and effectively countered by learning from the mistakes that led to the success of the attacks and initiating a process on the national and international levels of integrating security structures and implementing changes that have made 9/11 the last large scale terrorist strike on U.S. soil. To illustrate these accomplishments and to highlight future challenges, the volume examines the inextricably connected elements of policing and intelligence in counter-terrorism as well as how counter-terrorism practitioners and jihadists were transformed by one day of attacks, more than twenty years ago. The chapters in this book were originally published as a special issue of Journal of Policing, Intelligence and Counter Terrorism.
Download or read book From Mafia to Organised Crime written by Anna Sergi and published by Springer. This book was released on 2017-07-19 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents primary research conducted in Italy, USA, Australia and the UK on countering strategies and institutional perceptions of Italian mafias and local organized crime groups. Through interviews and interpretation of original documents, this study firstly demonstrates the interaction between institutional understanding of the criminal threats and historical events that have shaped these perceptions. Secondly, it combines analysis of policies and criminal law provisions to identify how policing models which combat mafia and organised crime activities are organized and constructed in each country within a comparative perspective. After presenting the similarities between the four differing policing models, Sergi pushes the comparison further by identifying both conceptual and procedural convergences and divergences across both the four models and within international frameworks. By looking at topics as varied as mafia mobility, money laundering, drug networks and gang violence, this book ultimately seeks to reconsider the conceptualizations of both mafia and organized crime from a socio-behavioural and cultural perspective.
Download or read book Prosecuting Crime in the Public Interest written by Kellie Toole and published by Bloomsbury Publishing. This book was released on 2024-07-25 with total page 233 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first detailed analysis of the decision to prosecute made by the statutory Australian Offices of Director of Prosecution. It examines the system of prosecution as part of the executive branch of government, and the role and challenges of the individual prosecutors who make decisions within the system. It explores the tension between prosecutorial independence and prosecutorial accountability, and the paradox that political involvement in prosecutions is necessary for accountability and to uphold the public interest, but can compromise independence. The book makes a unique contribution to both Australian criminal law scholarship and to the international literature on criminal prosecution, by drawing on the sub-disciplines of criminal law and administrative law. It includes case studies on prosecuting child sexual abuse, rape, and government espionage, and comparisons with common law and civil law countries including the USA, the UK, Italy and South Africa.
Download or read book Maintaining Peace and Security written by Trudy Fraser and published by Bloomsbury Publishing. This book was released on 2014-11-20 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: The security concerns of the United Nations today extend far beyond what the writers of the 1945 Charter could have imagined. As a result, the UN has been compelled to reconsider the parameters of what constitutes a threat to international peace and security, and what it means to be safe and secure in the twenty-first century. This text critically assesses the capacity of the UN to evolve in response to changing notions of security, and examines the complex history of people, places and politics that have helped shape this important global actor.

Download or read book A Question Of Trust written by David Anderson and published by Lulu.com. This book was released on 2015-06-11 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: [This convenience copy of the official report by the UK Independent Reviewer of Terrorism Legislation, made available under OGLv3 on a cost-only basis] Modern communications networks can be used by the unscrupulous for purposes ranging from cyber-attack, terrorism and espionage to fraud, kidnap and child sexual exploitation. A successful response to these threats depends on entrusting public bodies with the powers they need to identify and follow suspects in a borderless online world. But trust requires verification. Each intrusive power must be shown to be necessary, clearly spelled out in law, limited in accordance with international human rights standards and subject to demanding and visible safeguards. The current law is fragmented, obscure, under constant challenge and variable in the protections that it affords the innocent. It is time for a clean slate. This Report aims to help Parliament achieve a world-class framework for the regulation of these strong and vital powers.

Download or read book Expert evidence in criminal proceedings in England and Wales written by Great Britain: Law Commission and published by The Stationery Office. This book was released on 2011-03-22 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: This project addressed the admissibility of expert evidence in criminal proceedings in England and Wales. Currently, too much expert opinion evidence is admitted without adequate scrutiny because no clear test is being applied to determine whether the evidence is sufficiently reliable to be admitted. Juries may therefore be reaching conclusions on the basis of unreliable evidence, as confirmed by a number of miscarriages of justice in recent years. Following consultation on a discussion paper (LCCP 190, 2009, ISDBN 9780118404655) the Commission recommends that there should be a new reliability-based admissibility test for expert evidence in criminal proceedings. The test would not need to be applied routinely or unnecessarily, but it would be applied in appropriate cases and it would result in the exclusion of unreliable expert opinion evidence. Under the test, expert opinion evidence would not be admitted unless it was adjudged to be sufficiently reliable to go before a jury. The draft Criminal Evidence (Experts) Bill published with the report (as Appendix A) sets out the admissibility test and also provides the guidance judges would need when applying the test, setting out the key reasons why an expert's opinion evidence might be unreliable. The Bill also codifies (with slight modifications) the uncontroversial aspects of the present law, so that all the admissibility requirements for expert evidence would be set out in a single Act of Parliament and carry equal authority.

Download or read book China s Influence and American Interests written by Larry Diamond and published by Hoover Press. This book was released on 2019-08-01 with total page 223 pages. Available in PDF, EPUB and Kindle. Book excerpt: While Americans are generally aware of China's ambitions as a global economic and military superpower, few understand just how deeply and assertively that country has already sought to influence American society. As the authors of this volume write, it is time for a wake-up call. In documenting the extent of Beijing's expanding influence operations inside the United States, they aim to raise awareness of China's efforts to penetrate and sway a range of American institutions: state and local governments, academic institutions, think tanks, media, and businesses. And they highlight other aspects of the propagandistic “discourse war” waged by the Chinese government and Communist Party leaders that are less expected and more alarming, such as their view of Chinese Americans as members of a worldwide Chinese diaspora that owes undefined allegiance to the so-called Motherland.Featuring ideas and policy proposals from leading China specialists, China's Influence and American Interests argues that a successful future relationship requires a rebalancing toward greater transparency, reciprocity, and fairness. Throughout, the authors also strongly state the importance of avoiding casting aspersions on Chinese and on Chinese Americans, who constitute a vital portion of American society. But if the United States is to fare well in this increasingly adversarial relationship with China, Americans must have a far better sense of that country's ambitions and methods than they do now.
Download or read book In Pursuit of Justice written by Richard B. Zabel and published by . This book was released on 2008 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, there has been much controversy about the proper forum in which to prosecute and punish suspected terrorists. Some have endorsed aggressive use of military commissions; others have proposed an entirely new "national security court." However, as the nation strives for a vigorous and effective response to terrorism, we should not lose sight of the important tools that are already at our disposal, nor should we forget the costs and risks of seeking to break new ground by departing from established institutions and practices. As this White Paper shows, the existing criminal justice system has proved successful at handling a large number of important and challenging terrorism prosecutions over the past fifteen years-without sacrificing national security interests, rigorous standards of fairness and due process, or just punishment for those guilty of terrorism-related crimes.

Book excerpt: This report provides a summary of the anti-money laundering/combating the financing of terrorism (AML/CFT) measures in place in the People’s Republic of China (China)1 as at the date of the onsite visit (July 9–27, 2018). It analyzes the level of compliance with the Financial Action Task Force (FATF) 40 Recommendations and the level of effectiveness of China’s AML/CFT system and provides recommendations on how the system could be strengthened. China has undertaken a number of initiatives since 2002 that have contributed positively to its understanding of ML/TF risk, although some important gaps remain. Its framework for domestic AML/CFT cooperation and coordination is well established.
