Book The Foundations of Modern International Law on Indigenous and Tribal Peoples

Download or read book The Foundations of Modern International Law on Indigenous and Tribal Peoples written by Lee Swepston and published by BRILL. This book was released on 2018-09-11 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: Also available as a print set of two, see isbn 9789004373754 The International Labour Organization is responsible for the only two international Conventions for the protection of the rights and cultures of indigenous and tribal peoples - the Indigenous and Tribal Populations Convention, 1957 (No. 107) and the Indigenous and Tribal Peoples Convention, 1989 (No. 169) that revised and replaced it, and Convention No. 169 is the only one that can now be ratified. This volume, together with its companion published in 2015, make clear that the basic concepts and the very vocabulary of international human rights on indigenous and tribal peoples derives from these two Conventions. The adoption in 2007 of the UN Declaration on the Rights of Indigenous Peoples (UNDRIP), and the ongoing discussions in the international human rights community about the relative merits, impact and legal validity of the UN and ILO instruments, make it all the more important to understand how Convention 169 was adopted. The author of this unique study was responsible for many years for the supervision of both Conventions by the ILO, and was intimately involved in the adoption of the 1989 instrument, as well as in international discussions on the subject. In writing this two-volume study, he foregoes a strict “travaux” approach, and discusses the organizational precedents and the subsequent practice under these instruments. The supervision of the application of these Conventions is very largely unknown in the wider human rights community, and even in the more specialized “indigenous community” that forms a special subset of human rights activists. This guide may be of some help in redressing that situation.

Book The Maritime Labour Convention 2006 International Labour Law Redefined

Download or read book The Maritime Labour Convention 2006 International Labour Law Redefined written by Jennifer Lavelle and published by CRC Press. This book was released on 2013-12-13 with total page 399 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the Maritime Labour Convention now in force (as of August 2013), the shipping industry is faced with a new international convention that has comprehensive implications across all sectors. This vital text provides timely analysis and thought-provoking essays regarding the Convention’s application and enforcement in practice. Hailed as the "Seafarer’s Bill of Rights" and the "fourth pillar" of the international regulatory regime for quality shipping, the Maritime Labour Convention is set to significantly alter the playing field for key stakeholders. This book offers diverse and interesting commentary in respect of the Convention’s impact on core sectors of the shipping industry, identifying both strengths and weaknesses of the Convention, as well as potential hurdles that will need to be overcome. Each chapter focuses on a different aspect of the Convention, ranging from individual rights of the seafarer to challenges of flag State implementation. Special attention is given to enforcement through examination of the innovative measures provided in the Convention itself, along with discussion of domestic enforcement mechanisms in certain States. Furthermore, the book evaluates whether the Convention has filled existing gaps in maritime labour law, resolved prior difficulties or created new problems. This book expertly addresses issues of fundamental importance to national authorities, shipping professionals and associations, maritime lawyers and academics worldwide. ---In memory of Richard Shaw---

Book A Global Alliance Against Forced Labour

Download or read book A Global Alliance Against Forced Labour written by International Labour Office and published by International Labour Organization. This book was released on 2005 with total page 100 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report is an account of contemporary forced labour to date. It provides the first global and regional estimates by an international organization of forced labour in the world today, including the number of people affected and how many of them are victims of trafficking, as well as of the profits made by the criminals exploiting trafficked workers.Based on these data, the report highlights the gravity of the problem of forced labour. From this data emerges three major categories of forced labour: forced labour imposed by the State for economic, political or other purposes, forced labour linked to poverty and discrimination and forced labour that arises from migration and trafficking of workers across the world, often associated with globalization. The report provides evidence that the abolition of forced labour represents a challenge for virtually every country in the world industrialized, transition and developing countries alike. It assesses experience at the national level in taking up this challenge, with particular emphasis on the importance of sound laws and policies and their rigorous enforcement, as well as effective prevention strategies. The report also reviews the actions against forced labour taken over the past four years by the ILO and its tripartite partners governments, employers and workers. It calls for a new global alliance to relegate forced labour to history.
