Book Foreign Investor Misconduct in International Investment Law

Download or read book Foreign Investor Misconduct in International Investment Law written by Anna Kozyakova and published by Springer Nature. This book was released on 2020-11-12 with total page 266 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the issue of foreign investor misconduct in modern international investment law, focusing on the approach that international investment law as it currently operates has developed towards foreign investor misconduct. The term ‘misconduct’ is not a legal notion, but is used to describe a certain phenomenon, namely, a group/class of actions. This term is convenient since it makes it possible to introduce and describe the phenomenon as such, without a division into concrete types of conduct, like ‘abuse of process’, ‘violation of national law’, ‘corruption’, ‘investment contrary to international norms and standards’, etc. The term ‘misconduct’ is intended to embrace various kinds of conduct on the part of foreign investors that the system of international investment law does not accept – such as that which it regards as illegal, against public policy, or otherwise inappropriate – and triggers legal consequences. Rarely, however, does international investment law clearly articulate what it considers unacceptable investor conduct, and certainly not in any systematic fashion. As such, this book addresses the following questions: What types of investors’ conduct are legally unacceptable? What mechanisms are available to deal with unacceptable investors’ conduct, and what are the legal consequences?

Book The River Basin in History and Law

Download or read book The River Basin in History and Law written by Ludwik A. Teclaff and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: Fresh water is one of man's most vital needs. The distribution of water within river basins has a direct bearing on the organization of water resources development to meet this ever-expanding need. River basins, despite their very great diversity in other respects, have one physical characteristic in common: each is a more or less self-contained unit within whose bounds all the surface and part or all of the ground waters form an interconnected, interdependent system. This inter dependence has such far-reaching implications - for pollution and flood control, apportionment of supply, relations between upstream and downstream riparians, to mention only a few examples - that the river basin has become almost universally accepted (within the past 20 or 30 years at least) as the unit of optimal water resources de velopment. Professor Teclaff's work (which was originally submitted to the New York University School of Law as a doctoral dissertation) is the first fully developed response to the important resolution passed by the International Law Association at its New York meeting in I958 recognizing the legal nature of the international river basin. His study quite properly, therefore, poses the question whether the adoption of the river basin unit is a temporary phenomenon, reflecting the current stage of technology and of administrative, economic, and legal thought on water resources development, or whether the de terminative influence of the river basin's physical unity which has always operated in the past will continue to operate in the future.

Book Exclusive Use in an Inclusive Environment

Download or read book Exclusive Use in an Inclusive Environment written by Philip De Man and published by Springer. This book was released on 2016-07-25 with total page 514 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book aims to find a workable interpretation of the non-appropriation principle that is compatible with both the existing international space law framework and the move of the private space industry towards the mining of asteroids and other celestial bodies. It does so by analysing the rules on the use of orbits as limited natural resources as a concrete indication of how space resources can be exploited by one user while respecting the non-appropriation principle and the interests of other users in space. This analysis is complemented by a thorough review of the meaning of property rights in the context of the existing international space law regime. This allows the author to distinguish between the lawful exploitation and unlawful appropriation of resources in a manner that could pave the way for a workable asteroid mining regime that takes into account the needs of individual companies and the international community. Exclusive use in an inclusive environment frames the legal regime of the exploitation of natural resources in outer space as the most pressing example to date of the tension that arises between the rights of a single spacefaring actor and the interests of the broader international community. Though academic in its approach in dealing with one of the most fundamental issues of space law to date, the book has very practical ambitions. By offering a pragmatic interpretation of the space law principles that are likely to remain the legal foundations of asteroid mining for the foreseeable future, Exclusive use in an inclusive environment hopes to inform academics, practitioners and policymakers alike in their future attempts at working out a fair, equitable and effective management regime for the exploitation of natural resources in outer space.

Available in PDF, EPUB and Kindle. Book excerpt: The 'Cologne Commentary on Space Law' is a three-volume annotation on the written norms of space law as enunciated through the Treaties of the United Nations and its General Assembly Resolutions. Volume I focuses on the 1967 Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, including the Moon and Other Celestial Bodies, popularly known as the ?Outer Space Treaty?. A broad international authorship of twenty experts addresses the historical overview and provides a provision by-provision interpretation of the Outer Space Treaty. The other four UN Treaties, the 1968 Rescue Agreement, the 1972 Liability Convention, the 1975 Registration Convention and the 1979 Moon Agreement, are addressed in Volume II, which was published in 2013. Volume III (published in 2015) delves into the eight most relevant United Nations General Assembly Resolutions/Principles on space activities. On the occasion of the 50th anniversary of the Outer Space Treaty, Volume I of the 'Cologne Commentary on Space Law' has been translated into Russian.
