Book International Law and the Environment

Download or read book International Law and the Environment written by Tuomas Kuokkanen and published by BRILL. This book was released on 2002-10-01 with total page 447 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important book makes an original and modern contribution to the study of "international environmental law", addressing its development over three time periods: the traditional period, the modern era, and the post-modern period. Kuokkanen's thesis is this: in the traditional period there was no clear distinction between the protection of the environment and the exploitation of natural resources; during the modern period the subjects became completely separated; and in the post-modern era there has been an effort to reconcile economic interests and environmental concerns. The work challenges the reader to think about international environmental law and its development within a broader framework, and through a lens which differs from that taken elsewhere. The book presents an impressive panorama of the principal international legal developments over the past century in this area, and successfully pinpoints the tensions between environmental and economic objects over the past century. A timely and important contribution.

Book The Jordan River Dispute

Download or read book The Jordan River Dispute written by Samir N. Saliba and published by Springer. This book was released on 2012-12-06 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: In spite of the importance of the Jordan River dispute, there has been no comprehensive and systematic study of the problem. What few articles have been written so far have been fragmentary and essentially dealt with the history of the dispute. M. G. Ionides, in "The Disputed Waters of Jordan," Middle East Journal, Vol. 7 (I953), pp. I53 ff., Georgiana Stevens, in the "Jordan River V alley," International C on ciliation, No. 506 (I956), and more recently, Kathryn B. Doherty, in "The Jordan Waters Conflict," International Conciliation, No. 533 (I965), elaborate this theme. H. A. Smith, in the "Waters of the Jordan: a Problem of International Water Control," International Affairs, Vol. 25 (I949), pp. 4I5 ff. has been the exception. However, his work is outdated in that many other factors have entered the picture since I949. My purpose in writing this study is twofold. First, I have sought to update the writings in this field. Second, it is hoped that the findings of this study will give a clearer and a more objective insight into the problems involved. Primary sources for this study include United Nations documents, Arab and Israeli government publications, federal and international law cases dealing with river disputes, treaties, and newspapers. Sec ondary source materials include books, articles in learned journals, and others.

Book The International Law of Transboundary Groundwater Resources

Download or read book The International Law of Transboundary Groundwater Resources written by Gabriel Eckstein and published by Routledge. This book was released on 2017-09-14 with total page 255 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive review of the state of international law as it applies to transboundary groundwater resources and aquifers. The main focus is on recent developments and the emerging international law for transboundary aquifers as reflected in the practice of states and the work of the UN International Law Commission, UN Economic Commission for Europe, and International Law Association. The author takes an interdisciplinary approach to the subject matter and provides the scientific hydro-geological underpinning for the application of law and policy to transboundary groundwater resources. He also addresses the growing global dependence on this hidden resource, as well as both the historical and scientific context for development of the law. The book provides case examples throughout to illustrate the various concepts and developments. These include more detailed examinations of the few existing transboundary aquifer agreements in operation, such as for aquifers between France and Switzerland and Jordan and Saudi Arabia, as well as aquifers in North Africa and in South America.

Book Common Law of International Organizations

Download or read book Common Law of International Organizations written by Finn Seyersted and published by BRILL. This book was released on 2008-06-30 with total page 632 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work provides a comprehensive theory of the system of legal norms that are developed partly in the internal written (constitutional) law of intergovernmental organizations and partly through their consistent practice, and that are therefore common to intergovernmental organizations. The legal construction presented in this volume consists of the following main elements: As for all other self-governing communities all intergovernmental organizations possess their own internal law governing their relations with 1) the organs of the organization, 2) the officials and 3) the member states in their capacity as members of the organization. Some organizations exercise in addition extended (delegated) jurisdiction over states, other organizations and/or individuals. Secondly, as for other self-governing communities all intergovernmental organizations are subjects of public international law in their relations with other self-governing communities (states and other intergovernmental organizations), and in the case of extended jurisdiction, also in relations with individuals and private entities. Thirdly, as for all other self-governing communities possessing its own internal law (its distinct lex personalis), intergovernmental organizations enter into relations of a private law nature with both public and private entities. Governed by the rules on conflict of laws, these relations must be determined by assessing relevant 1) personal, 2) territorial and 3) organic connecting factors. Thus Common Law of Intergovernmental Organizations brings together all those elements pertaining to the theory of objective legal personality that have been presented in a scattered fashion, in bits and pieces. Common Law of Intergovernmental Organizations, starting out from the position of objective legal personality, is fully compatible with modern requirements of good governance and accountability of international organizations, and particularly adaptable to the ideal of “systemic integration” of legal regimes constituting internal law of the organization.
