Book excerpt: Excerpt from Report of the Committee on Federal Relations, 1863 Let us look to the history of our action, here and elsewhere, and the causes which have led to the ascendency of the majority in this chamber. It was manifest before the adjournment of Congress, at the first regular session, that the whole policy of the Administration, in conducting the war, had been changed, and that new and start ling measures were inaugurated at Washington. This created wide-spread alarm among the people in all the free States, and aroused a sentiment which demanded a convocation of a Mass Convention of conservative and loyal citizens at Indianapolis. That Convention was held on the 3oth day of July, 1862. It was called to give utterance to its sentiments in regard to the measures to which we have alluded. We can not better define the position of the majority of the Senate and the other House, and 'of the people of Indiana, than by giving the resolutions adopted by the vast concourse Of your fellow-citizens which assembled on that occasion. They are as follows: Resolutions adopted at the Mass. Meeting of the Democrats and other Conservative Citizens of Indiana, July 30, 1862. Resolved, That the Constitution, the American Union, and the laws made under and by the authority of the Constitution. Must be preserved and maintained in their proper and rightful supremacy; that the rebellion now in arms against them must be suppressed and put down. And that it is the duty Of all good citizens to aid the General Government in all measures necessary and proper to that end. Book excerpt: Excerpt from Report of the Committee on Federal Relations: With the Report of the Peace Commissioners Appointed to Wait on Presidents Lincoln and Davis The President of the United States, by his Proclamation of the 15th of April, had called upon a portion of the States to place at his disposal a body of militia, to the number of seventy-five thousand men. The Proclamation was directed against the people of the newly-formed Southern Confederacy, and its purposes and policy were obvious, although its terms were technically shaped in conformity with the Act of Congress of 1795. It recited, with formal precision, in the language of the Act, "that the laws of the United States were opposed, and the execution thereof was obstructed," in the seven seceded States, "by combinations too powerful to be suppressed by the ordinary course of judicial proceedings, or by the powers vested in the Marshals," and it called forth the militia of the other States, in the further language of the statute, "to suppress such combinations, and to cause the laws to be duly executed." In pursuance of another section of the law, it then commanded "the insurgents to disperse and retire peaceably to their respective abodes" within twenty days. If there is any proposition clear beyond dispute, it must be, that if the occasion which authorizes the President to call out the militia, under the Act of 1795, existed at all, it was declared, by the explicit terms of the Proclamation, to exist only in the States of the Southern Confederacy, which were therein enumerated. It is equally indisputable, as matter of law, that the militia, if called out lawfully at all, were lawfully empowered to execute the laws and suppress unlawful combinations in the seven States named, and in none other. Such a conclusion of law is not only obvious and unavoidable, as matter of construction, but equally to be insisted upon as matter of principle and self-protection on the part of the people; for the exercise of the military power, in a free government, is never to be permitted, except within the limits and under the severest restrictions and checks of the law. If a President of the United States, under the fraudulent pretence of suppressing unlawful combinations in Louisiana and Florida, could be permitted to call out troops, to be used for any purpose in Maryland or Virginia, no soil of any State would be free from invasion, and no right of the citizen anywhere would be secure against overthrow. It was not, however, because of any apprehension that the militia which were called out by the President would be used in other than the designated quarters, that the Proclamation created an intense and immediate excitement in the Southern and Border Slave States. Sectional omnipotence claimed by the North, in the administration of the Government of the United States. Undoubtedly, the Constitution does not authorize the assumption of the powers claimed by the North ern States. It was established on the principle of non-interven tion by the General Government, as to all local or sectional inter ests whatever. Its framers were perfectly aware of the essential difference between the States composing the United States, in climate, productions and pursuits of industry. There was but one way, that different people, with such various interests, could live free and harmoniously under one Government. All local or sectional interests must be left to the exclusive governance of the people to whom they belonged; and only such general interests should be committed to the control of a common Gov ornment, as would make all equal, and equally protected in their exercise. Any policy, therefore, which is local or sectional in its Operations, must, from the very nature of the constitution, be unconstitutional. If this great principle of the Constitution had been observed, there would have been no serious divisions or contests amongst the people of the United States. The interest of one section of the Union was the interest of all, in the powers exercised by the General Government. Hence, a sectional majority could not exist. Differences in policy in carrying out the provisions of the Constitution would be com mon to all sections of the l'nion; and a majority could not op press a minority, without oppressing themselves. Party con tests for power, however much they may rage, could not effect the stability of the Union. Antagonisms would be within the sphere of general interests, to be protected and promoted by general powers, and would not arise between opposing sections of the Union. Book excerpt: Even before shots were fired at Fort Sumter, slaves recognized that their bondage was at the root of the war, and they began running to the Union army. By the war's end, nearly half a million had taken refuge behind Union lines in improvised "contraband camps". These were crowded and dangerous places, with conditions approaching those of a humanitarian crisis, yet families and individuals took unimaginable risks to reach them, and they became the first places where many Northerners would come to know former slaves en masse. Drawing on records of the Union and Confederate armies, the letters and diaries of soldiers, transcribed testimonies of former slaves, and more, Manning sweeps us along, from the contraband camps, sharing insight and stories of individuals and armies on the move, to debates in the halls of Congress. The alliances between former slaves and Union soldiers which were warily begun in the contraband camps would forge a dramatically new but highly imperfect alliance between the government and the African Americans. That alliance would outlast the war, and help destroy slavery and ward off the very acute and surprisingly tenacious danger of re-enslavement. It also raised, for the first time, humanitarian questions about refugees in wartime and legal questions about civil and military authority with which we still wrestle, as well as redefined American citizenship, to the benefit but also to the lasting cost of African Americans. --
