Book excerpt: Internal security is often hailed as a rapidly expanding area of European integration, with a growing number of strategies, policies and framework agreements in recent years. Yet actual cooperation, when viewed closely, proceeds at a halting pace – raising questions as to why cooperation appears so problematic. This book presents a novel, theoretically-informed way to understand internal security cooperation in Europe. The approach treats internal security as a "public good" requiring collective action amongst sovereign governments. All governments must contribute to the production of a public good; once produced, the public good benefits all governments. Fundamental obstacles to producing a public good thus arise, and can help explain the underlying difficulties facing European cooperation on internal security matters. The chapters in this book apply a public goods approach to different internal security issues, ranging from terrorism to border management, and from environmental security to natural disasters. Each study demonstrates how the various goals of internal security cooperation resemble different forms of public goods – and thus present different kinds of obstacles to effective cooperation. This book fills a theoretical gap in the literature on European internal security cooperation with a proven approach increasingly used in other scholarly fields. Book excerpt: Despite the growing national and international regulatory framework to support cross-border mediation, the use of such mediation appears to remain stubbornly low. This book focuses in particular on the European Union’s (EU’s) continued efforts to encourage the use of cross-border mediation and examines why such efforts have had a limited impact. It does so by drawing on rare, and at times surprising, detailed insights from in-house counsel of multinational companies regarding their use of EU cross-border commercial mediation. By viewing mediation through the lens of disputants, new and important findings regarding why disputants do, and do not, use cross-border mediation have emerged. While these findings are of primary relevance to EU policy and practice, they have implications far beyond the EU context at a time of increasing international interest in cross-border mediation. The analysis of the insights provided by the disputants reveals, for example: the prominent role played by negotiation as a cross-border dispute resolution process; that negotiation is a key comparator for disputants when considering whether to use mediation; how the EU’s continued focus on understanding and presenting mediation as an alternative to litigation has resulted in measures which are insufficient to address fully the barriers to the use of mediation; intriguing barriers to the use of mediation which arise from the association which disputants draw between mediation and negotiation; how the relationship which disputants draw between mediation and negotiation paradoxically raises both opportunities for, and obstacles to, the increased use of mediation; and what disputants need in order to increase their use of cross-border mediation. The qualitative nature (by way of interviews) of the research conducted for this book has enabled the identification of nuanced and novel findings regarding mediation’s position and potential in cross-border dispute resolution. These findings, together with a detailed examination of the EU Directive on Certain Aspects of Mediation in Civil and Commercial Matters and the EU’s continued initiatives to foster the use of mediation, form the foundation upon which this book’s recommendations are built. Changing the frame to view the use of mediation through the disputants’ perspective, as this book does, provides the opportunity for the EU to promote cross-border mediation in a way which resonates more deeply with disputants and responds more fully to their concerns and needs. This thought-provoking book will be of interest not only to European and national bodies seeking to promote the use of mediation but clearly also to dispute resolution academics, in-house counsel, and of course mediators and dispute resolution practitioners in general.

Book excerpt: This open access book presents an actor-centered study on Europeanization, based on the assumption that EU-driven reforms are highly dependent on the behavior and interests of the key domestic actors. Whether or not a state pursues a European and democratic agenda depends on domestic lawmakers. Further, political elites are pre-eminent in deciding on the nature, form and content of any law, and on the extent to which the rule of law is actually enforced. Elites can overcome structural or institutional barriers that stand in the way of achieving their goals. The empirical study on Romania presented here lends this observation a more profound meaning: it shows how, in contexts where high level corruption is the norm rather than the exception, self-serving political elites cannot be expected to genuinely commit to adopting sound anti-corruption reform. The book is an inquiry into the motivations that drive legislators to make particular decisions, but also into the structural characteristics and dynamics of the elite that invite a selfish rather than responsible and responsive behaviour. David Jacobs asks, why are national support instruments for electricity from renewable energy sources converging, even though the harmonisation of these frameworks at the European level has failed? Which causal mechanisms lead to cross-national policy similarities? And what are the implications for policy coordination in the EU? The author traces the evolution of feed-in tariffs - the most successful and most widely used support mechanism for renewable electricity - in Germany, Spain and France. He reveals increasing cross-national policy similarities in feed-in tariff design - despite the failure of harmonizing instruments at the European level. He explains these increasing policy similarities by applying policy convergence theory. Policy convergence can occur voluntarily, based on transnational communication, regulatory competition and technological innovations and these findings have important implications for European policy steering. The key to this book is the interrelation of an innovative theoretical concept (coordination of policies in the international arena via voluntary cooperation) with a very topical empirical research focus - the promotion of renewable energies in the EU.
