Drawing from more than 330 interviews and a year and a half of field research, it develops a case study of the international intervention during the Democratic Republic of the Congo's unsuccessful transition from war to peace and democracy (2003-2006). Grassroots rivalries over land, resources, and political power motivated widespread violence. However, a dominant peacebuilding culture shaped the intervention strategy in a way that precluded action on local conflicts, ultimately dooming the international efforts to end the deadliest conflict since World War II. Most international actors interpreted continued fighting as the consequence of national and regional tensions alone. UN staff and diplomats viewed intervention at the macro levels as their only legitimate responsibility. The dominant culture constructed local peacebuilding as such an unimportant, unfamiliar, and unmanageable task that neither shocking events nor resistance from select individuals could convince international actors to reevaluate their understanding of violence and intervention.

The mass atrocity norm known as the Responsibility to Protect (R2P) has enjoyed meteoric success since the concept was introduced in 2001. But perhaps precisely because of how quickly the concept secured its privileged place in the pantheon of ideas and concerns in international affairs, many fundamental questions remain concerning its origins, its conceptual contents, and its relevance to actual cases of mass atrocity. This book seeks to explore that terrain by drawing together a group of scholars diverse enough to engage with the complex array of political, legal and ethical questions raised by R2P. Critical questions raised here include: What are the limits of the authority that R2P confers on international actors? What does the evolution of R2P mean for North-South relations? Just how significant is R2P in the context of the broader human rights landscape? In addition to those conceptual and theoretical matters, special attention is given to the operational context in which the meaning of R2P is ultimately rendered. The government army is one of the main perpetrators. Commanders, even when confronted with abuses, have frequently failed to stop sexual violence and may themselves be guilty of war crimes or crimes against humanity as a consequence. In this report, Human Rights Watch looks at sexual violence committed by the army and more specifically the 14th brigade whose case illustrates the failure to enforce respect for humanitarian law. The Congolese government and international agencies have taken some measures to deal with the army's poor human rights record, sometimes as part of broader security sector reform. These efforts have so far seen only limited success. For example, while some foot soldiers have been brought to justice, commanders are usually spared prosecution. To end impunity for the military, the Congolese government should strengthen the weak military justice system; establish clear chains of command, remove army officers with responsibility for past crimes, train military of all ranks on protection of women and girls, and improve pay and living conditions for soldiers. The government should also consider establishing a mixed chamber composed of international and Congolese judges and prosecutors to prosecute military and civilian leaders responsible \ for war crimes and crimes against humanity, including sexual crimes, beyond the few individuals who will be tried by the International Criminal Court.

It analyses the duty to intervene to stop the commission of serious abuses of human rights by analysing the meaning and practical consequences for troops, in terms of civilian protection, of the Article 1 duty to respect and ensure respect for the Geneva Conventions; of the duty to secure human rights (found in most international human rights treaties); and of the duty to restore law and order in an occupation. The book also analyzes the extent of troops' obligations to provide protection in light of various different operational and legal contexts in and discusses 'grey areas' and lacuna of coverage. A discussion of whether new approaches are needed, for example where operations are undertaken explicitly to protect people from serious violations of their human rights follows; and the book concludes by offering some guidelines for troops faced with such violations.

These economies did not emerge in vacuum, but are part and parcel of the history of people and place. This book explores the informal and illicit extraction and trade of minerals and other types of natural resources that takes place in the 'borderlands' during periods of conflict. This type of extraction and marketing, often referred to as ‘conflict trade’ depends on a weak state, and works alongside the structures of the state and its officials. The book emphasises that conflicts do not start as competition over natural resources and in turn suggests that the integration of the extraction and marketing of natural resources only starts once fighting is well under way. Boas argues that although economic agendas are an integral part of African conflicts, the desire to accumulate is not the only motivation. Thus, in order to present a more comprehensive analysis of conflict we need to take into account political, cultural, and historical factors, in addition to the economic dimensions of conflict. This book will be of very strong interest to students and scholars of political economy, conflict studies, international relations and development.
