In investigating the legal question, I was necessarily led to consider the legislative one; and at the request of a friend deeply interested in the subject, I wrote a short pamphlet entitled Summary of Objections to the Doctrine that a Marriage with the Sister of a Deceased Wife is contrary to Law, Religion or Morality, which was printed for private circulation in 1839, and afterwards reprinted in the Law Magazine. This is mentioned to account for any similarity of thought or expression that may be observed between it and the following Remarks; in which an attempt is made to maintain the ground taken in the Summary, against fresh and formidable controversialists. Xviii. 18, is not t be confused with its interpretation. Dr. M'caul naturally insist much upon the translation, and in addition to his own critica judgment, allowed to be of great weight from his known eminenc as an Hebrew Scholar, he gives many authorities in favour o the rendering as it stands in the text of our authorized version Still it is to be remarked that the authorities whom he cites fo the translation are by no means at one with him as to the inter pretation. This point will be found very fully treated of in th second letter of the present Lord Chancellor to the Dean 0 Westminster, printed in and, if I remember rightly, i was also examined and the result put very forcibly by the Bishol: of Exeter in the postscript to his letter to the late Bishop 0 Lichfield, published, I believe, in 1860, where it is observantly noted that of all our Reformers cited by Dr. M'caul as having accepted the authorized version as to the rendering of Lev. Xviii. 18, there is not one who has gone with him in the application 0 it which he advocates, inasmach as they have all either explicitly or implicitly received our table of prohibited degrees: a proo that even from Dr. M'caul's premiss, as to the translation, the have not come to his conclusion as to the interpretation. And it is plainly in the interpretation, not in the mere translation, that the above-mentioned contradiction is involved. Book excerpt: Excerpt from Review of Several Late Publications on Marriage With a Deceased Wife's Sister: Condemning This Proposed Innovation on Our Religious Institutions If, after all, it be said, that an injunction to a man to marry his brother's widow renders it at least allowable for a woman to marry her late sister's husband, it may be replied, firstly, that the argument itself admits that a permission, and if a permission then a prohibition, may be transferred from one sex to the 0ther - the very ground on which we contend that a prohibition to a woman to marry her husband's brother included a prohib itien to a man to marry his wife's sister; and secondly, that, if this injunction be binding on us, and be not, as we contend, a. Local and national law applicable to the case of the Jews at that time, and to them only, then it must be taken with all its adjuncts also, and it is good for him, and for him alone, who marries his brother's widow, there being no child of such first marriage. We proceed, then, to consider not what in the judgment of any individual may be the Scriptural view of the particular case, but what is the interpretation of Scripture, which, for at least fifteen centuries, has been recognized and affirmed by the Church.
