Mapping the Legal Boundaries of Belonging explores the complex relationship between religion and multiculturalism and the role of the state and law in the creation of boundaries. The intersection between religion, nationalism and other vectors of difference in Canada and Israel offer an ideal laboratory in which to examine multiculturalism in particular and the governance of diversity in general. The contributors to this volume investigate concepts of religious difference and diversity and the ways in which these two states and legal systems understand and respond to them. As a consequence of a purportedly secular human rights perspective, they show, state laws may appear to define religious identity in a way that contradicts the definition found within a particular religion. Both state and religion make the same mistake if they take a court decision that emphasizes individual belief and practice as effecting a direct modification of a religious norm: the court lacks the power to change the authoritative internal definition of who belongs to a particular faith. Similarly, in the pursuit of a particular model of social diversity, the state may adopt policies that imply a particular private/public distinction foreign to some religious traditions.

Book excerpt: Israel still maintains a highly pluralistic personal status system (millet) that it inherited from the Ottoman Empire. Under this archaic system, religious courts of fourteen ethno-religious communities, staffed with their very own judges who apply religious and customary laws of their own communities, are granted exclusive jurisdiction over matters of marriage and divorce and concurrent jurisdiction with the civil courts in regard to issues of maintenance and succession. Millet-like systems had been historically employed by imperial powers to segregate and categorize their colonial subjects into racial, ethno-religious and tribal groupings, exclude the subaltern groups from the spoils of power, and deny them the terms of equal membership in the political community. In many regards, the retention of this archaic system by such a modern and democratic polity as the Israeli state was quite paradoxical, given that from the very moment of its inception, the Jewish state has pledged itself to guarantee its citizens' freedom of religion and conscience, and to ensure complete equality of its all inhabitants irrespective of religion, race, or gender. In this respect, there are two central puzzles guiding the analysis below: One, why Israel, as a highly centralized and democratic polity, has maintained such a fragmented system of law and courts which accentuates religious, ethnic and gender-based inequalities. Two, how such a polycentric application of law and justice affects individuals' fundamental rights and freedoms, and what tactics and strategies people employ to cope with the limitations imposed upon their rights by communal institutions.

Book excerpt: Rival understandings of the meaning and practice of the religious and the secular lead to rival public perspectives about religion and religious freedom in North America. This book explores how debates over the American Office of Religious Freedom and its International Religious Freedom Act (IRFA, 1998) and very recent debates over the Canadian Office of Religious Freedom (2013) have pitted at least six basic, but very different meanings of the religious and the secular against each other in often undisclosed and usually unproductive ways. Properly naming this ‘religious problem’ is a critical first step to acknowledging and conciliating their practically polar political prescriptions. It must be considered how we are to think about religion in political offices, both the Canadian and the American experience, as an essentially contested term, and one which demands better than postmodern paralysis, what the author terms political theology. This is especially critical since both of these cases are not just about how to deal with religion at home, but how to engage with religion abroad, where real peril, and real practical policy must be undertaken to protect increasingly besieged religious minorities. Finally, a principled pluralist approach to the religious and the secular suggests a way to think outside the ‘religious problem’ and productively enlist and engage the forces of religion resurging around the globe. The book will be of great use to scholars and students in religion and foreign affairs, secularization, political theology, and political theory, as well as professionals and policy makers working in issues relating to religion, religious freedom, and foreign affairs.
