Book excerpt: "This paper assesses and measures regulatory governance in 21 infrastructure regulators in Brazil. Regulatory Governance is decomposed into four main attributes: autonomy; decision-rules; means and tools; and accountability. A ranking is proposed and the main areas for improvement identified. A comparison of the proposed regulatory governance index and other indexes internationally available is performed. Section 2 sets up the analytical framework for the report, identifying key components of regulatory governance, namely, autonomy (political and financial), procedures for decision-making, tools and means (including personnel), and accountability. Section 3 assesses each of these components in practice, reporting the results of a survey with 21 regulatory agencies in Brazil, which was designed and implemented in 2005. Section 4 measures regulatory governance based on three related indexes, ranks the Brazilian regulators among themselves, and compares the proposed indexes with other two indicators available in the literature. Section 5 presents the conclusions."

Book excerpt: Mining plays a crucial role in Brazil's economy. Nonetheless, the efforts and resources devoted to regulatory quality in the sector, including the enforcement of rules, have not always been commensurate. This report identifies the gaps, barriers, implementation flaws and inefficiencies in the regulatory framework of the mining sector in Brazil. It takes stock of the recent reforms in the mining sector in Brazil, identifies areas that pose the greatest challenges for effective regulation in mining. It also describes the reforms that created the National Mining Agency of Brazil, its governance arrangements and its current regulatory practices. These are assessed against OECD principles in regulatory policy and mining regulation, as well as against country experiences from Australia, Chile, and Mexico. Finally, recommendations are provided to support further reform efforts.

Revenues from extractive industries (EIs) have major macroeconomic implications. The EIs account for over half of government revenues in many petroleum-rich countries, and for over 20 percent in mining countries. About one-third of IMF member countries find (or could find) resource revenues “macro-critical” – especially with large numbers of recent new discoveries and planned oil, gas, and mining developments. IMF policy advice and technical assistance in the field has massively expanded in recent years – driven by demand from member countries and supported by increased donor finance. More specifically, it aims to understand a puzzling phenomenon. Since the 1990s, the approach of risk-based governance has been widely adopted in almost all developed countries in Europe and commonwealth countries. It, however, has diffused much more slowly in the U.S. Using a diffusion approach and comparisons between Australia and the U.S., this book examines mechanisms that both drive and prevent the diffusion of risk-based governance in the coal mining industry. This book has two major selling points. First, this is a timely work given the Upper Big Branch coal mine explosion occurred in April, 2010. After this disaster, many asked why an enhanced level of enforcement after 2006 has not prevented catastrophic accidents from occurring and why risk-based governance, which helps other countries achieve better safety performance, has been largely ignored in the U.S. This book answers these questions and makes recommendations on how to remove barriers in moving toward risk-based governance. Second, this book is readable because it embeds theories into storytelling and gives particular emphasis on the influence of key strategic individuals.
