Army, in Force March 22, 1906 Sir: I have the honor to submit herewith a revised and corrected compendium of general orders and circulars issued from this office, together with citations from Army Regulations, from Decisions of the Comptroller of the Treasury, and from the Opinions of the Judge-Advocate General of the Army in matters affecting officers of the Corps of Engineers. 2. The publication of a similar compendium for use of the officers of this corps was authorized by the Secretary of War June 26, 1902, and it has been found to be exceedingly useful and helpful as well as a great convenience, but the lapse of time and the many changes in orders, etc., render it highly desirable that a new edition, corrected to date, be provided for engineer officers charged with the duty of disbursing public funds. 3. I have therefore to recommend that authority be given for printing and binding 400 copies of the accompanying compendium, which embodies no changes in that heretofore authorized excepting such modifications and additions as arc necessitated by the provisions of orders, circulars, etc., issued since the edition authorized in 1902 was printed. 4. If the authority now asked for is granted, it is proposed to include in the compendium the approved Engineer Regulations as at present in force, but no changes or modifications in these regulations are involved. Every one will agree that, so far as it can be done by legislation, the laws should protect the public from being deceived in the foods which nourish them or in the medicines which are relied on to cure their ills. But to formulate a law which will effectively protect the public without depriving it of freedom to eat what it may choose to 'eat and to take such remedies as it may wish to take, and without serious disturbance of business conditions, and especially to formulate a. Federal law which will do this with out transcending the powers conferred on the Congress by the Constitution, is a matter of great difficulty. It is not surprising that the Food and Drugs Act is in some respects difficult to understand. Some of the questions as to its meaning have been answered by expressions of opinion from the Department of Agriculture. Other questions have not been answered and cannot be answered definitely until the meaning of the Act has been determined by the courts. In the matter here contained I have presented such information bearing upon the Act as can be gathered from the decisions given out by the Department of Agriculture, the published expressions of opinion of officials charged with the enforce ment of the Act, and the views expressed by those who have studied the Act with especial care in the interest of the manufacturers of and dealers in particular lines of food and drug products. (3962) Uniform system of. - There shall be maintained a uniform system of free public schools for all children between the ages of five and twenty-one years. 4486. (3963) Board of education; its meetings - The board of education created by the constitution shall hold its sessions at the seat of government. It may appoint the time of meeting, and a called meeting of the board may he held at any time upon the call of a member thereof. 4487. (3965) The same; to decide appeals - The board of education shall decide all appeals from the decisions of county superintendents, or from the decisions of the state superintendent; but all matters relating to appeals shall be presented in writing, and the board's decision shall be final. 4488. (3967) The same; to remove them in certain cases. - For continued neglect of duty, for drunkenness, incompetency or official misconduct, the board of education may remove a county superintendent; but before removal the officer shall have ten days' notice of the charge, and be allowed opportunity to make defense. The members of the board are authorized to administer oaths, and to take or cause depositions to be taken, and have the powers of a court to compel witnesses to attend and testify in all matters of investigation by the board. 4489.
