Book excerpt: Until recently, companies that engaged in telephone solicitation or telemarketing were required to maintain a list of consumers who ask not to be called, but there was little or no federal oversight of these lists. Regulations recently promulgated by the Federal Trade Commission and the Federal Communications Commission create a nationwide do-not-call registry and require telemarketers to begin using the do-notcall lists later this year. In addition to the new national list, thirty-six states have enacted laws that create some type of state-wide do-not-call registry. This report will discuss current federal regulation of the telemarketing industry, including the new regulations promulgated by the Federal Trade Commission and the Federal Communications Commission, as well as state laws creating do-not-call registries. Legal challenges to the do-not-call registry, including the recent decision by the United States District Court for the Western District of Oklahoma finding that the FTC lacked authority to establish the registry and the decision by the United States District Court for the District of Colorado invalidating the registry on First Amendment grounds, will also be discussed. Also addressed is the federal legislation (S. 1652, S. 1654, S. 1655 and H.R. 3161) aimed at overturning the Oklahoma court's decision, and other relevant legislation (H.R. 395 and H.R. 526). This report will be updated as events warrant. The FCC, FTC, and several consumer groups and government/business partnerships identified in this book provide extensive information on telemarketing. This book provides summaries of the federal laws and regulations particular to telemarketing, the establishment of a national do-not-call registry, and on the options that are available to consumers to attempt to limit the calls that they receive from telemarketers and to report questionable telemarketing practices to local or federal authorities.

Updated as of May 29, 2018 In this document, the Federal Communications Commission ("FCC" or "Commission") revises its rules to: require prior express written consent for all autodialed or prerecorded telemarketing calls to wireless numbers and for prerecorded calls to residential lines and, accordingly, eliminate the established business relationship exemption for such calls to residential lines while maintaining flexibility in the form of consent needed for purely informational calls; require all prerecorded telemarketing calls to allow consumers to opt out of future prerecorded telemarketing calls using an interactive, automated opt-out mechanism; and limit permissible abandoned calls on a per-calling campaign basis, in order to discourage intrusive calling campaigns. The Commision also exempts from its telemarketing requirements prerecorded calls to residential lines made by health care-related entities governed by the Health Insurance Portability and Accountability Act of 1996. Taken together, today's actions offer consumers greater protection from intrusive telemarketing calls and protect consumers from unwanted autodialed or prerecorded telemarketing calls to wireless numbers and from unwanted prerecorded telemarketing calls to residential lines, also known as "telemarketing robocalls," and maximize consistency with the analogous Telemarketing Sales Rule ("TSR") of the Federal Trade Commission ("FTC"), as contemplated by the Do-Not-Call Implementation Act ("DNCIA") in a way that reduces industry confusion about telemarketers' obligations and does not increase compliance burdens for most telemarketers. And since the late 1970s, "deregulation" has become perhaps the most ubiquitous political catchword of all. This book takes on the critics of government regulation. Providing the first major alternative to conventional arguments grounded in public choice theory, it demonstrates that regulatory government can, and on important occasions does, advance general interests. Unlike previous accounts, Regulation and Public Interests takes agencies' decision-making rules rather than legislative incentives as a central determinant of regulatory outcomes. Drawing from both political science and law, Steven Croley argues that such rules, together with agencies' larger decision-making environments, enhance agency autonomy. Agency personnel inclined to undertake regulatory initiatives that generate large but diffuse benefits (while imposing smaller but more concentrated costs) can use decision-making rules to develop socially beneficial regulations even over the objections of Congress and influential interest groups. This book thus provides a qualified defense of regulatory government. Its illustrative case studies include the development of tobacco rulemaking by the Food and Drug Administration, ozone and particulate matter rules by the Environmental Protection Agency, the Forest Service's "roadless" policy for national forests, and regulatory initiatives by the Securities and Exchange Commission and the Federal Trade Commission.

A robocall, also known as "voice broadcasting," is any telephone call that delivers a prerecorded message using an automatic (computerized) telephone dialing system, more commonly referred to as an automatic dialer or "autodialer". When the call is answered, the autodialer either connects the call to a live person or plays a prerecorded message. Both are considered robocalls. Some robocalls use personalized audio messages to simulate an actual personal phone call. As discussed in more detail below (in "Classification of Telemarketing Calls"), the TCPA prohibits robocalls to ·consumers' traditional landline numbers, ·consumers' Voice-over-Internet-Protocol (VoIP) landline numbers, and ·all mobile numbers. Robocalls to business landlines are not covered by the TCPA. Robocalls are popular with many industry groups, such as real estate, telemarketing, and direct sales companies. The majority of companies who use robocalling are legitimate businesses, but some are not. Those illegitimate businesses may not just be annoying consumersâthey may also be trying to defraud them. This book deals with important issues involving robocalls.
