However, although sustainable investments are steadily increasing, there still remain large gaps within financing and the information that financial markets rely on is often incomplete or incorrect. For instance, the financial system has been structured around short-term frameworks and goals while the most pressing environmental and social challenges are long-term. Prices do not convey the cost of externalities associated with social and environmental challenges. It is therefore important to implement the effective pricing of externalities and create a common language and taxonomy between investors, issuers and policy-makers in order to best serve sustainable development. Addressing this challenge, the authors delve deeper into the levers that can be pulled within the financial system to prompt an efficient ecosystem of sustainability-related information, allowing social and environmental externalities to be incorporated into the decision-making process of all market agents. Book excerpt: "The adoption, in 2015, of both the Sustainable Development Goals and the Paris Agreement focused attention on a fundamental rethinking of many aspects of society. Indeed, the European Commission’s 2018 Sustainable Finance Action Plan called for a comprehensive shift in how the financial system works. This research explores the expectations of a sustainable financial system and critically assesses the extent to which the EU’s sustainable finance strategy, and the regulations adopted pursuant to that strategy, align with, exceed, or fall short of such expectations.The research makes three principal contributions. First, it develops an assessment framework for the critical analysis of sustainable finance strategy and regulation. Second, it presents a series of critical analyses covering the 2018 Action Plan, the Taxonomy Regulation, the SFDR and a series of amendments to existing capital markets regulations. Finally, the research offers seven concrete suggestions as to how the EU could develop a sustainable finance strategy that is more coherent, transparent, and better aligned with expectations of a sustainable financial system. In particular, it is suggested that (i) more realistic intentions are communicated, (ii) inclusiveness is better safe-guarded, (iii) a stronger conception of sustainability is adopted, (iv) greater transparency is provided with respect to the contribution of the financial system to both sustainability goals and inequitable outcomes, (v) financial regulation be reclaimed from the economic rationale, (vi) a regulatory architecture based on free-choice may be insufficient to reposition the financial system towards sustainability, and that (vii) methods be developed to manage conflicts of interest arising as a result of the co-regulatory approach adopted pursuant to EU sustainable finance regulation. The research primarily employs a critical legal studies methodology. It also, however, draws on the methodologies and work of scholars in the fields of rhetorical analysis, historical narrative analysis, systems thinking, law and economics and utilises Kuhn’s theory of paradigm shifts. The study illustrates how academic research, through the methodical construction and application of a critical assessment framework, can contribute to a better understanding of and, as necessary, the realignment of policy."--

Book excerpt: Since the European Commission adopted an action plan for promoting sustainable finance in 2018, legislative reform has been introduced for enhanced market building in sustainable finance products as well as to harmonize the regulative standards for them. Regulation is intended to mobilize the mainstream investment fund sector to develop and provide choice in their offers of sustainable financial products, hence it can be regarded as enabling in nature. It is also in the nature of harmonized European regulation to provide for sufficiently high-quality regulative and protective standards so that market development is carried out in a manner that inspires market confidence. This is consistent with the ordoliberal underpinnings of single market regulatory measures in the financial sector. However, regulative standards tend towards high-quality in order to underpin market credibility, but they may sometimes be counterproductive if 'idealism' becomes too demanding. This article examines the Regulation on sustainability disclosures required of the financial services sector and the Taxonomy Regulation in their roles to make sustainable finance products widely marketised by the mainstream investment funds sector. It examines the finely balanced nature of the EU's governance of sustainable finance as its enabling elements and regulative ones interact. We argue that the net result is mixed messages to the market which may not lead to significant development in market structures and product choice. We further interrogate a lacuna in law that investment advice is not adequately regulated in relation to sustainable financial product offerings.
