Book excerpt: The role of sub-national bodies in EU decision-making has grown. In this regard, significant changes were introduced by the Treaty of Lisbon, which inserted an explicit reference to the sub-national dimension of the subsidiarity principle, and granted the Committee of the Regions the right to bring an action for annulment. While the 'Early Warning Mechanism' for subsidiarity monitoring is primarily concerned with national parliaments, regional parliaments with legislative powers form a separate category of bodies caught by the protocol and may play an advisory role. Existing research, however, points to problems and challenges which regional parliaments face in engaging in genuine subsidiarity monitoring. Ex-ante subsidiarity monitoring is complemented by the possibility of ex post judicial review. Generally, challenges to Union acts on subsidiarity grounds are infrequent. At the same time, it is agreed that the very possibility of judicial review forces greater weight to be given to subsidiarity concerns during the preparation of Union law and encourages EU institutions to consider carefully whether an issue is best addressed at the European, national, regional or local level.

Previous academic (comparative) research in relation to the accession of the C- tral and Eastern European Countries was primarily focused on the constitutional adaptations. While the present study certainly starts with presenting the Hungarian constitutional context, it is going far beyond that by examining and evaluating the national legislative and administrative structures and mechanisms. In particular in relation to that last aspect, the study can be characterised as pioneering work. For Hungary – but probably also for many other countries – in a number of respects, the author has conducted unique research, based on empirical data and on not pre- ously collected and analysed government and parliament documents. This book is warmly recommended to anybody interested in the, until now, little explored and partly also practical implications of EU-membership of, in particular, the post-communist countries.

State power is today exercised in the context of the complex institutional environment of the EU. But what of regions and sub-national actors? Are their interests adequately represented; can they advance them or can they,at least, protect them from unwitting or calculated damage? This book surveys the broad questions of law and political science and investigates the contribution of the EU's Committee of the Regions and also 'bottom-up' initiatives launched by the regions themselves. Given that much regional autonomy has been hard won, one would suppose that the centralising influence flowing from the EU's intrusion into the domestic settlement would be treated with extreme caution by the regions. Moreover, among the Member States there is great diversity in the patterns of political organisation adopted to cope with the tension between the centralisation of power and respect for local autonomy. Case studies including Spain, Germany and Finland reveal that there is no single consistent historical narrative. States change, as the UK's recent experience illustrates. The book offers findings that are interesting at a general level in investigating patterns of multi-level governance, but is also rich in case-specific information.

In a Europe of strong regional sentiments, some even find it difficult to see the state as the most obvious unit of political representation. Against this backdrop, this book maps and examines the role regions play with regard to national government and the European Union, respectively. Does the European Union constitute an escape route for regions by offering an alternative political arena where they may act independently from the state? How do regions participate in European policy-making? And, what is it that determines whether or not regions manage to take direct part in the EU system? By constructing a broad quantitative measure of regional participation, this study makes it possible to analyze in a more rigorous and sophisticated manner than before what it is that determines regional participation in EU policy-making. Using OLS regression analysis, the author examines the effect of a series of explanatory variables on participation, finding that regional autonomy is the key determinant for political participation of regions in the EU.

Looking at each member state in turn the authors emphasize the diversity of the European experience. European integration has differing impacts on different regions. In some it is seen as a threat, centralizing power and increasing their peripherality. To others it is an opportunity to by-pass national governments and assert their personality. The authors are sceptical of the `Europe of the Regions' scenario, in which nation states fade away in favour of the other two levels.
