Book excerpt: Minority and indigenous women in Kenya are discriminated against on multiple levels; they are targeted because of their identification with a minority or indigenous group, and as women – both by cultural practices within their own community and because of gender discrimination more widely. This report examines the challenges and the new opportunities that have emerged with the passing of the new Constitution in 2010. The goal of the report is to reflect the voices and experiences of women from diverse minority and indigenous communities in Kenya. For hunter-gatherer women, many of whom have been displaced and forced to become squatters, community land rights are a primary concern. They view their lack of opportunities, basic services and education for girls as a direct result of their displacement. For pastoralist women, insecurity and conflict in areas where they live has a disproportionate impact on them. Cultural practices that are harmful to girls, such as female genital mutilation and early marriage, reduce girls’ access to education and entrench women’s poverty. For fisher peoples, environmental degradation and collapsing fish stocks are major fears. Women from these communities expressed their frustration at traditional gender roles that place much of the responsibility for meeting the family’s basic needs on women. While there is strong leadership from individual women in many of the minority and indigenous communities described in this report, the majority of women face ongoing violations of their human rights. Trapped in a cycle of poverty that they attribute directly to decades of marginalization, they fear that they and their children will not be able to take advantage of gains in the new Constitution. This report highlights actions identified by minority and indigenous women that should be taken by the government and other actors to support women’s empowerment and participation in the decision-making processes that directly affect them.

It pays more attention to territorial contestations, maritime disputes, vulnerabilities of landlocked states, and expansionist policies as displayed through spatial organizational regimes. These areas of investigation have previously been largely studied from the narrow perspective of ‘location’, unduly focusing on comparative advantages of ‘distance’, while neglecting the influence of ‘forces’ such as technology, ideology, and the power of mental mapping in spatial decision making. This volume puts forward the argument that the harmonious relationship between states, and efficient exploitation of the blue economy ecosystem in ways that promote peace between states, lies not only in the structural transformation of markets, but also in bridging the spatial and social divide between the coastal and hinterland societies. Thus, this work proffers possibilities for a holistic regime for managing Africa’s coastal-hinterland continuum through innovative strategies such as SMART blue economies and the infusion of the geopolitical dimension into the management of maritime and territorial diplomacy. The Politics of Distributing Social Transfers in Sub-Saharan Africa and South Asia provides a systematic analysis of the political processes shaping the distribution of social transfers in six countries in Sub-Saharan Africa and South Asia. In doing so, the book addresses a notable gap in recent research on social protection concerning the politics of implementation. While considerable attention has been devoted to debating the merits of different policy designs and the political factors shaping the adoption and diffusion of different policy models, ultimately the ability of any social transfer programme to deliver on its promises is dependent on the effective implementation and distribution of social transfers in line with intended objectives. The chapters in this book examine international and sub-national variation in programme implementation in Bangladesh, Ethiopia, Ghana, Kenya, Nepal, and Rwanda, drawing on a common analytical framework that highlights the importance of state capacity and reach, rooted in histories of state formation, and contemporary political competition in shaping the distribution of social transfers. Comparative analysis of the case studies supports the view that variation in the capacity and reach of the state within countries is a centrally important factor shaping the effectiveness and impartiality of distribution. Yet state capacity alone is insufficient. Rather political competition and power relations shape how this capacity is actually deployed in practice. As such, the book underscores the inherently political nature of implementation and questions common technocratic efforts to improve implementation by de-politicizing the social protection policy process.

The constitutional, legal and institutional framework for the removal of county Governors from office through impeachment in the Kenyan devolved system is examined. The removal process of county Governors effectively for the realization of the objects of devolution in Kenya is accessed. Nigerian jurisprudence on gubernatorial impeachment is used because it provides instructive lessons on interpreting the Kenyan constitutional provisions on the removal of county Governors through impeachment. The result of this study is that the gubernatorial impeachment process in the Kenyan devolved system is a three-way process. The starting point is the County Assembly (CA) where the Member of County Assembly can table an impeachment motion against the county Governor. Secondly, should the impeachment motion succeed against the sitting county Governor, the Speaker of the CA forwards the resolution to the Senators who then investigate the impeachment claims made against the county Governor. Lastly, where the county Governor facing impeachment proceedings feels that their rights are being violated and or the CA and Senate are not following the stipulated procedure, they are allowed to access the courts to be granted appropriate reliefs. The jurisprudence emerging from the Kenyan courts has been useful in this research. Nigerian jurisprudence on gubernatorial impeachment has also been useful on providing instructive lessons on how the Kenyan constitutional provisions on the removal of county Governors from office can be interpreted. This legal research paper concludes that for the intended purpose of gubernatorial impeachment to be achieved, the people must not only be informed and involved in the removal process of their county Governors but the CAs and Senators must also demonstrate political goodwill while conducting this constitutional process. This is because one of the ways through which the objects of devolution can be achieved in the Kenyan devolved system is through accountable governance from the State Officer.

The jurisprudence emerging from the Kenyan courts has been useful in this research. South African jurisprudence on the management of intergovernmental disputes has also been useful on providing instructive lessons on how the Kenyan constitutional provisions on the management of intergovernmental disputes can be interpreted. This legal research paper concludes that purposive interpretation of the constitutional provisions dealing with the management of intergovernmental disputes must be adopted. This is because one of the ways through which the objects of devolution can be achieved in the Kenyan devolved system is through the efficient management of intergovernmental disputes.
