Common structures of a national state were not visible in the African country. Somalia, even though far from politically stable under the dictator Siad Barre, had been suffering even more after the down-fall of the regime in 1991. Ever since, war, destruction, hunger and poverty had been predominant in the fragile state. It lacked organisation, authority and essential structures. Terrorist groups as well as warlords shaped the political landscape of the country. And although Somalia had transitional administrations from 2004, it did not have a functioning central government until the 2012 election of President Hassan Sheikh Mohamud. Shortland and Percy described the situation accurately by stating: “anarchy on land means piracy at sea”.

Given the scarcity of regional capabilities to police these waters, Coalition naval forces maintain a maritime security presence in the region. These forces have had some notable successes, but face a complex challenge in suppressing piracy and human smuggling. At the heart of this maritime problem is the vast and ungoverned land area of Somalia, in which chaos creates too many incentives and not enough deterrence for maritime criminal activity. The recent creation of a United States Africa Command (USAFRICOM) places the landmass of Africa (except Egypt) inside the AFRICOM AOR. As a result, the dynamic waters surrounding the Horn of Africa will soon lay on a seam between the USCENTCOM AOR and USAFRICOM AOR, creating new challenges and opportunities for conducting maritime security operations in the region. This paper will first discuss the operational factors that affect maritime security efforts to date. It will then examine command and control implications brought about by the creation of USAFRICOM and the combatant commanders shifting seams of responsibility. Finally, it will make recommendations on how to work effectively across this dynamic seam of responsibility to the benefit of both USAFRICOM and USCENTCOM.

For more than a decade, the Indian Ocean waters adjoining Somalia have been a particular locus of such activities, with pirates hijacking vessels, and Al Qaeda and Al Shabab elements travelling between Africa and the Arabian Peninsula, operating lucrative businesses and even staging deadly operations at sea. However, these operations and threats remain, by and large, understudied. Responses to the two threats have varied, highlighting the lack of cohesive regional and global institutions with the mandate and the capacity to address them. Those scholarly deliberations on Indian Ocean maritime security focus on piracy and armed robbery at sea, while their terrorist/insurgent counterparts have eluded sustained scrutiny. This volume will help close that gap by looking at both from the field in Somalia and Yemen, within broader frameworks of regional maritime security and port-state control, international maritime law and the ongoing search for maritime resources. The European, African and Middle Eastern case studies add salience to the regional and international complexity surrounding maritime security off the Horn of Africa. This book was originally published as a special issue of the Journal of the Indian Ocean Region.

The seizing of cargo ships and ransom demands have harmful economic impacts to companies and countries. Piracy operations directly threaten U.S. interests and citizens, as displayed during a recent kidnap for ransom action that led to the deaths of four Americans. In addition, piracy affects global trade. Despite significant multinational counter piracy efforts, which has included U.S. agencies and military forces, merchant vessels continue to be pirated regularly. Piracy off the coast of Somalia exists largely because Somalia is a failed state with little to no rule of law or domestic law enforcement capability. The economic situation of the people living in Somalia is dire. A lack of viable employment opportunities, a shortage of arable land, continuing drought, and increasing competition from other nations fishing off the coast, have all affected the standard of living. The conventional wisdom is that the solution lies ashore; meaning the establishment of good governance and economic development in Somalia, but the international community has displayed no interest to engage in nation building. This thesis will describe the challenges and ineffectiveness of current multi-national counter piracy operations and discuss how the international community can best combat piracy in the HOA region from a maritime perspective. By reviewing how states have historically responded to piracy and examining international legal approaches, the author will propose a multi-tiered coalition-based naval force solution, which uses all the traditional advantages of naval power to eliminate piracy without resorting to nation building."--Abstract.

Book excerpt: The growing threat of piracy in the Gulf of Guinea poses a direct threat to the economic and security interests of Nigeria and the entire West African region. With the largest population and economy in the region, Nigeria arguably stands to lose the most if the maritime security environment continues to decline, but the entire region will suffer as well. Major international powers like the United States and Europe are increasingly dependent on oil from the region, and the continued decline of maritime security holds that revenue stream, which is sorely needed for regional development, at risk. As evident by the rising maritime threat level in the region, no single nation has the capacity to unilaterally combat piracy and subsequently improve maritime security. Recent improvements in maritime security, both in the Malacca Strait and along Africa's East Coast, demonstrate how regional approaches can create opportunities for coastal regions to apply the principle of unity of effort through cooperation. This paper will show that these regional bodies share common lines of effort that improve maritime security by reducing the gaps in which pirates operate. Given the nature and extent of the current maritime security environment in the Gulf of Guinea, it is clear that a realistic strategy on the part of Nigeria and the other gulf nations must begin at the regional level.

Book excerpt: As the so-called Arab Spring has slid into political uncertainty, lingering insecurity and civil conflict, European and American initial enthusiasm for anti-authoritarian protests has given way to growing concerns that revolutionary turmoil in North Africa may in fact have exposed the West to new risks. Critical in cementing this conviction has been the realisation that developments originated from Arab Mediterranean countries and spread to the Sahel have now such a potential to affect Western security and interests as to warrant even military intervention, as France’s operation in Mali attests. EU and US involvement in fighting piracy off the Horn of Africa had already laid bare the nexus between their security interests and protracted crises in sub-Saharan Africa. But the new centrality acquired by the Sahel after the Arab uprisings – particularly after Libya’s civil war – has elevated this nexus to a new, larger dimension. The centre of gravity of Europe’s security may be swinging to Africa, encompassing a wide portion of the continental landmass extending south of Mediterranean coastal states. The recrudescence of the terrorist threat from Mali to Algeria might pave the way to an American pivot to Africa, thus requiring fresh thinking on how the European Union and the United States can better collaborate with each other and with relevant regional actors.

An effective strategy for resolving the threat of piracy in the long-term will require the international community to engage in extensive development efforts on land; to work with African partner nations to increase the capacity and capabilities of national and regional governments; and to provide viable economic alternatives to would-be pirates. Many of these strategies are already underway in West Africa, where the United States government in particular has undertaken a broadly holistic approach to maritime security. The security and political situation in Somalia has so been far less conducive to a land-based approach: but it is certainly within the US interest to explore development- and governance-based counter-piracy initiatives as circumstances allow. Unless the international community becomes willing to invest in a land-based solution to Somalia's dire political, economic, and humanitarian distress, the plague of Somali piracy will continue.

The outbreak of Somali piracy that started in 2008 has prompted a similar revolution in maritime security. Private security companies began operating armed escort vessels to protect merchant shipping against pirates off the Horn of Africa. Private Anti-Piracy Navies is intended to provide a contextualized understanding of the historical origins, current state, and future prospects of this fast-changing sector. Centuries ago, the British East India Company used a private navy against piracy in the same waters with much success. Yet since then, international law has evolved to more tightly regulate the use of force by civilians, and to afford greater protections to suspected pirates. Thus, the development of what are in effect private warships has presented numerous legal and regulatory problems. How can the companies that operate these vessels be effectively licensed? Under what circumstances should they be allowed to use lethal force? This book explains how regulators in industry and government have attempted to answer such questions, and highlights the remaining areas of uncertainty. It also addresses the economic factors that drive the struggle between pirates and anti-piracy forces. Of equal concern are operational considerations such as defensive tactics, logistics, and rules of engagement. Security companies must carefully balance rights concerns against the need to defend ships effectively. Partly due to the contribution of private security, piracy in the Indian Ocean has dropped significantly over the past two years, leading to widespread overconfidence. Governments under severe budget pressure may withdraw their naval task forces from the region prematurely, leading to a resurgence of Somali piracy. At the same time, pirates are wreaking havoc in the Gulf of Guinea off West Africa. The book concludes with an assessment of private naval forces’ prospects in these conflicts over the short term, as well as the implications for wider naval privatization in the long run.
