Book excerpt: Indigenous women migrants from Central America and Mexico face harrowing experiences of violence before, during, and after their migration to the United States, like all asylum seekers. But as Shannon Speed argues, the circumstances for Indigenous women are especially devastating, given their disproportionate vulnerability to neoliberal economic and political policies and practices in Latin America and the United States, including policing, detention, and human trafficking. Speed dubs this vulnerability "neoliberal multicriminalism" and identifies its relation to settler structures of Indigenous dispossession and elimination. Using innovative ethnographic practices to record and recount stories from Indigenous women in U.S. detention, Speed demonstrates that these women's vulnerability to individual and state violence is not rooted in a failure to exercise agency. Rather, it is a structural condition, created and reinforced by settler colonialism, which consistently deploys racial and gender ideologies to manage the ongoing business of occupation and capitalist exploitation. With sensitive narration and sophisticated analysis, this book reveals the human consequences of state policy and practices throughout the Americas and adds vital new context for understanding the circumstances of migrants seeking asylum in the United States.

Here in this book are outlined, along with the achievements, the shortcomings and the most pressing challenges. Far from seeking an extemporaneous autonomy, Social History of Punitive Institutions wants to try to find its own feasibility based on intersections and good mixings. Those objectives were considered by the Study Group about History of Prison and Punitive Institutions (Grupo de Estudio sobre la Historia de la Prisión y las Instituciones Punitivas, GEHPIP) –an interuniversity team and with central office at Universidad de Castilla-La Mancha (UCLM)– when organising what it decided to name in an homonymous way 1st International Congress on History of Prison and Punitive Institutions (I Congreso Internacional sobre Historia de la Prisión y las Instituciones Punitivas), held in Ciudad Real (Spain) from 10 to 12 April 2013. Book excerpt: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction.

The book thus presents two types of papers, the first being descriptive and analytical academic papers on whole systems of juvenile justice or certain parts thereof (e.g., aftercare, restorative justice, etc.). These topics are presented as essential for the development of new juvenile justice systems. The second group of papers deal with efforts to promote reform through international activity (PRI, DCI, DIHR), and through efforts to utilise modern theory in national reforms in developing countries (Malawi, Nepal, and Serbia) or in countries experiencing current or recent political and systemic changes or developments (South Africa, Germany, and Poland). The volume is also intended to throw light on recent trends in juvenile crime in various countries, the relationship between actual developments and popular and political perceptions and reactions to such developments, including the efforts to locate effective alternatives to the incarceration of young offenders. At the same time as the search for such alternatives is being intensified through international exchange and experimentation, the amelioration of harsh measures against juvenile law violators is often countered by political and public outcries for security and demonstrative public intervention against misbehavior. A streak of new moralism is clearly discernable as a counteracting force against more humane reform efforts. The volume throws light on developments in the actual parameters of juvenile offending, public and political demands for security and public intervention, and measures to provide interventions which are at the same time compatible with international human rights instruments.

Despite major political and economic gains, crime has increased in every Latin American country over the past 25 years, currently making this region the most crime-ridden and violent in the world. Over the past two decades, Latin America has enjoyed economic growth, poverty and inequality reduction, rising consumer demand, and spreading democracy, but it also endured a dramatic outbreak of violence and property crimes. In More Money, More Crime, Marcelo Bergman argues that prosperity enhanced demand for stolen and illicit goods supplied by illegal rackets. Crime surged as weak states and outdated criminal justice systems could not meet the challenge posed by new profitably criminal enterprises. Based on large-scale data sets, including surveys from inmates and victims, Bergman analyzes the development of crime as a business in the region, and the inability-and at times complicity-of state agencies and officers to successfully contain it. While organized crime has grown, Latin American governments have lacked the social vision to promote sustainable upward mobility, and have failed to improve the technical capacities of law enforcement agencies to deter criminality. The weak state responses have only further entrenched the influence of criminal groups making them all the more difficult to dismantle. More Money, More Crime is a sobering study that foresees a continued rise in violence while prosperity increases unless governments develop appropriate responses to crime and promote genuine social inclusion.

Book excerpt: Contributing to the literature on comparative criminal procedure and Latin American law, this book examines the effects of adversarial criminal justice reforms on victim’s rights by specifically analyzing the Colombian criminal justice reform of the early 2000s. This research focuses on the production, interpretation, and implementation of rules and institutions by exploring how different actors have employed the concept of victims and victims’ rights to promote their agendas in the context of criminal justice reforms. It also analyzes how the goals of these agendas have interplayed in practice. By the early 2000s, it seemed that the Colombian criminal justice system was headed towards a process characterized by broader victim participation, primarily because of the doctrine of the Constitutional Court on victims’ rights. But in 2002, the Colombian Attorney General promoted a more adversarial criminal justice reform. This book argues that this reform represented a sudden and unpredicted reversal of the Constitutional Court’s doctrine on victim participation, even though one of the central justifications for the reform was the need to satisfy human rights standards and adhere to the jurisprudence of the Constitutional Court on victims’ rights. In the criminal justice reform of the early 2000s and its subsequent modifications, the promotion of a dichotomous interpretation of the adversarial model—which conceived the criminal process as a competition between prosecution and defense—served to limit victim participation. This study examines how conceptions of victims’ rights emerged out of the struggles between different and at times competing agendas. In the Colombian process of reform, victims’ rights have been invoked both as a justification for criminal sanctions and as an explanation for crime prevention and restorative justice. After assessing quantitative and qualitative data, this book concludes that punitive approaches to victims’ rights have prevailed over restorative justice perspectives. Furthermore, it argues that punitiveness in the criminal justice system has not resulted in more protection for victims. Ultimately, this research reveals that the adversarial criminal justice reform of the early 2000s has not substantially improved the protection of victims’ rights in Colombia.
