In The Friendly Liquidation of the Past—one of the first texts to examine this issue comprehensively —Van Cott focuses on the efforts of Bolivia and Colombia to incorporate ethnic rights into their fragile democracies. In the1990s, political leaders and social movements in Bolivia and Colombia expressed dissatisfaction with the quality of democracy--its exclusionary nature, the distance and illegitimacy of the state, and the empty promise of citizenship. The highly symbolic act of constitution making elevated a public struggle for rights to the level of a discussion on the meaning of democracy and the nature of the state. Based on interviews with more than 100 participants in the reforms, Van Cott demonstrates how issues promoted by social movements—recognizing ethnic diversity, expanding political participation and improving representation, and creating spheres of cultural and territorial autonomy—were placed on the constitutional reform agenda and transformed through strategic interaction with political power-brokers into the nation’s highest law. The analysis follows each reform through five years of implementation to assess the early results of what Van Cott suggests is an emerging regional model of multicultural constitutionalism. The Friendly Liquidation of the Past fills an important gap in the study of ethnic politics and constitutional reform in the Andes, linking the literature on institutions and political reform to work in political theory on participatory democracy and multiculturalism.

No son pocas las preocupaciones o inquietudes que la democracia suscita en esta parte del mundo, y muestra de ello son los más variados estudios e informes sobre el estado actual de la democracia y sus probabilidades en América Latina. Más de un cuarto de siglo de ejercicio democrático en casi toda la región parecería sugerirnos que la democracia echó raíces en esta área y que su consolidación que está asegurada. Sin embargo, nada más paradójico, lejos de su afianzamiento parecería que está más cerca de la fragilidad. Los desencantos son cada vez más evidentes.Los regímenes democráticos de la región afrontan en la actualidad los más complejos problemas, en donde los gobiernos, en sentido amplio, no han logrado dar una respuesta efectiva: profundas desigualdades, altos niveles de pobreza, merma en el crecimiento económico, ausencia de creación empleo, que se terminan convirtiendo en los motivos o causas que justifican la insatisfacción ciudadana con el funcionamiento de la democracia y sus instituciones. De ahí pues que la región se haya caracterizado por la realización de los más diversos procesos de reforma constitucional, política y electoral, quizá con el propósito de superar otros malestares que afectan a al democracia: representación, participación, gobernabilidad. Y aquí nuevamente el tema del presidencialismo latinoamericano y sus posibles conexiones con las debilidades de la democracia en América Latina.Esta obra examina precisamente los desafíos, ventajas y desventajas del régimen presidencial en la región, sobre la base de juiciosas investigaciones en distintos contextos nacionales, con énfasis en México, Argentina, Perú y Colombia, con un alto grado de homogeneidad en sus presupuestos teóricos y metodológicos. These are remarkable developments in a region where ethnic cleavages were once universally described as weak. Recently, however, indigenous activists and elected officials have increasingly shaped national political deliberations. Deborah Yashar explains the contemporary and uneven emergence of Latin American indigenous movements - addressing both why indigenous identities have become politically salient in the contemporary period and why they have translated into significant political organizations in some places and not others. She argues that ethnic politics can best be explained through a comparative historical approach that analyzes three factors: changing citizenship regimes, social networks, and political associational space. Her argument provides insight into the fragility and unevenness of Latin America's third wave democracies and has broader implications for the ways in which we theorize the relationship between citizenship, states, identity, and social action.

Frente a este panorama, los ensayos que integran esta obra insisten en el valor excepcional del derecho constitucional latinoamericano comparado, como instrumento y referencia para las reformas constitucionales, al mismo tiempo que analizan las repercusiones que derivarían de querer resolver con este tipo de reformas, problemas que no son de índole jurídica, como la falta de voluntad política para solucionar los asuntos, la ineficacia, la incompetencia, la corrupción, la impunidad, el desprecio al Estado de derecho, la no aplicación de la ley, entre otros factores. La obra conduce a despejar confusiones sobre las instituciones, tales como los mitos de que un sistema parlamentario opera por esencia de manera más democrática que uno presidencial y que, con un cambio de sistema de gobierno se resolverían muchos de los problemas políticos, jurídicos y sociales, que castigan a varios países de la región. En ese sentido, este trabajo subraya la necesidad de tener en cuenta que en nuestros países no se deben cometer errores que puedan implicar debilidades o retrocesos en los regímenes democráticos alcanzados.
