Book excerpt: This book stems from the CyberBRICS project, which is the first major attempt to produce a comparative analysis of Internet regulations in the BRICS countries – namely, Brazil, Russia, India, China, and South Africa. The project has three main objectives: 1) to map existing regulations; 2) to identify best practices; and 3) to develop policy recommendations in the various areas that compose cybersecurity governance, with a particular focus on the strategies adopted by the BRICS countries to date. Each study covers five essential dimensions of cybersecurity: data protection, consumer protection, cybercrime, the preservation of public order, and cyberdefense. The BRICS countries were selected not only for their size and growing economic and geopolitical relevance but also because, over the next decade, projected Internet growth is expected to occur predominantly in these countries. Consequently, the technology, policy and governance arrangements defined by the BRICS countries are likely to impact not only the 3.2 billion people living in them, but also the individuals and businesses that choose to utilize increasingly popular applications and services developed in BRICS countries according to BRICS standards. Researchers, regulators, start-up innovators and other Internet stakeholders will find this book a valuable guide to the inner workings of key cyber policies in this rapidly growing region.

  • ISBN : 8591689925
  • Pages : 410 pages

Download or read book Globalization of contractual law written by Frederico Eduardo Zenedin Glitz and published by Frederico Glitz Consultoria Jurídica. This book was released on 2014-12-01 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book adopts the proposition that it is possible to the customs to be sources of contractual obligations. To support that premise, it was necessary to seek jurisprudential (arbitration and litigation) and comparative basis. Even more, due to contract law internationalization, customary international sources should be subject of domestic treatment, as they provide contractual obligations as well as they work as contractual interpretation tool. However, one can´t neglect the need to control the customary content. In detailed terms, then, we can say that the role reserved for the custom as contractual law rules source has always been residual in Brazilian law. Accompanying the modern European experience, doctrine and Brazilian legislation emphasize the secondary, when not merely interpretive, role of the contractual custom. In turn, Brazilian case law wasn´t able to give general treatment to contractual custom. Moreover, the process of reducing distances and cultural, social and economic approximation, usually called globalization, influenced the contracts through the incorporation of a number of solutions brought from the international trade practice. Although they might be justified by the age-old principle of freedom, somehow these international "uses" insinuate themselves into Brazil to the point of requiring that the Brazilian Courts themselves to give them treatment and shelter. On one side, if you deny the existence of a creative normative role in contractual custom by another, albeit indirect, is recognized not only their existence but the possibility of foreign origin. This paradoxical treatment reflects, to some extent, another consequence: the Brazilian contract law is in the process of internationalization. Here, then, a new confrontation is announced: a broad creative freedom (a tributary of the so-called Lex mercatoria) and the foreign act incorporation control (public policy). Unlike before, however, no simplistic answer would be feasible, particularly because of the complexity of contemporary and regulatory Brazilian contract law.

  • Author : Jason Hackworth
  • Publisher : Cornell University Press

Download or read book The Neoliberal City written by Jason Hackworth and published by Cornell University Press. This book was released on 2014-01-15 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: The shift in the ideological winds toward a "free-market" economy has brought profound effects in urban areas. The Neoliberal City presents an overview of the effect of these changes on today's cities. The term "neoliberalism" was originally used in reference to a set of practices that first-world institutions like the IMF and World Bank impose on third-world countries and cities. The support of unimpeded trade and individual freedoms and the discouragement of state regulation and social spending are the putative centerpieces of this vision. More and more, though, people have come to recognize that first-world cities are undergoing the same processes. In The Neoliberal City, Jason Hackworth argues that neoliberal policies are in fact having a profound effect on the nature and direction of urbanization in the United States and other wealthy countries, and that much can be learned from studying its effect. He explores the impact that neoliberalism has had on three aspects of urbanization in the United States: governance, urban form, and social movements. The American inner city is seen as a crucial battle zone for the wider neoliberal transition primarily because it embodies neoliberalism's antithesis, Keynesian egalitarian liberalism. Focusing on issues such as gentrification in New York City; public-housing policy in New York, Chicago, and Seattle; downtown redevelopment in Phoenix; and urban-landscape change in New Brunswick, N.J., Hackworth shows us how material and symbolic changes to institutions, neighborhoods, and entire urban regions can be traced in part to the rise of neoliberalism.

Book Economies of Abandonment

Download or read book Economies of Abandonment written by Elizabeth A. Povinelli and published by Duke University Press Books. This book was released on 2011-11-11 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Economies of Abandonment, Elizabeth A. Povinelli explores how late liberal imaginaries of tense, eventfulness, and ethical substance make the global distribution of life and death, hope and harm, and endurance and exhaustion not merely sensible but also just. She presents new ways of conceptualizing formations of power in late liberalism—the shape that liberal governmentality has taken as it has responded to a series of legitimacy crises in the wake of anticolonial and new social movements and, more recently, the “clash of civilizations” after September 11. Based on longstanding ethnographic work in Australia and the United States, as well as critical readings of legal, academic, and activist texts, Povinelli examines how alternative social worlds and projects generate new possibilities of life in the context of ordinary and extraordinary acts of neglect and surveillance. She focuses particularly on social projects that have not yet achieved a concrete existence but persist at the threshold of possible existence. By addressing the question of the endurance, let alone the survival, of alternative forms of life, Povinelli opens new ethical and political questions.
