Book Prosecuting Domestic Abuse in Neoliberal Times

Download or read book Prosecuting Domestic Abuse in Neoliberal Times written by Antonia Porter and published by Springer Nature. This book was released on 2020-11-12 with total page 248 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that past inattentive treatment by state criminal justice agencies in relation to domestic abuse is now being self-consciously reversed by neoliberal governing agendas intent on denouncing crime and holding offenders to account. Criminal prosecutions are key to the UK government’s strategy to end Violence Against Women and Girls. Crown Prosecution Service policy affirms that domestic abuse offences are ‘particularly serious’ and prosecutors are reminded that it will be rare that the ‘public interest’ will not require of such offences through the criminal courts. Seeking to unpick some of the discourses and perspectives that may have contributed to the current prosecutorial commitment, the book considers its emergence within the context of the women’s movement, feminist scholarship and an era of neoliberalism. Three empirical chapters explore the prosecution commitment on the one hand, and the impact on women’s lives on the other. The book’s final substantive chapter offers a distinctive normative conceptual framework through which practitioners may think about women who have experienced domestic abuse that will have both intellectual appeal and practical application.

Book Prosecuting Domestic Violence A Review of Current Policy Research and Practice Initiatives

Download or read book Prosecuting Domestic Violence A Review of Current Policy Research and Practice Initiatives written by and published by . This book was released on 2000 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This paper describes current innovations developed or used by prosecutors as applied specifically towards domestic violence. Both the increasing demand for a more effective criminal justice system response to domestic violence and the changing role of the prosecutor have fostered the development and implementation of many innovative strategies for dealing with the unique issues and problems related to domestic violence. After discussing the history of domestic violence prosecution and its influence on the changing role of the prosecutor, the paper reviews four general types of initiatives currently employed by prosecutors specific to domestic violence cases. Each is described in terms of its prevalence, advantages, limitations, and relative success. General limitations and constraints inherent to domestic violence, prosecution, and policy evaluation are also discussed. Finally, policy recommendations relative to current research and practice are presented. Given the lack of conclusive research and the variability among jurisdictions, prosecutors must often rely on their own evaluations in measuring the effectiveness of their programs. While most innovations are tested largely only through direct implementation, continued research is certainly warranted, and should be undertaken in conjunction with the most promising practices.

Download or read book Abetting Batterers written by Andrew R. Klein and published by Rowman & Littlefield. This book was released on 2020-02-24 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Whatever the number, domestic violence victims remain far too many for a preventable crime. More and more victims of intimate partner violence are reaching out to police, prosecutors and judges only to be sorely disappointed, even betrayed. While laws and programs have multiplied over the last few decades to address domestic violence, the country is getting safer for almost everyone except for women who have, or have had, abusive male intimate partners. Andrew R. Klein and Jessica L. Klein look at the criminal justice response to domestic violence across America today, ranging from police to prosecutors and courtrooms across the nation. Abetting Batterers reveals the troubling pattern of inattention and incompetence that compromises the safety of women and encourages their male abusers to continue their abuse and violence. Although criminal justice system agencies vary among cities, towns and counties within the same state they all too often relegate domestic violence to the backburners of the system, dismissing victims and ignoring even the most serious and chronic abusers. The variation reveals the real problem in preventing intimate partner violence lies in these agencies’ commitment and will, rather than their ability to do the job. The authors unveil what is working in regard to protecting victims of domestic violence and holding their abusers accountable, and they suggest strategies for ensuring that what is being done right can be replicated and become the law and practice across the nation. The wide variation in how intimate partner violence is handled by similar jurisdictions demonstrates the real problem in preventing it lies in these agencies’ commitment, rather than ability to do the job. This book proves to be invaluable in understanding what is and is not being done in the reality of domestic violence in America.

Book Domestic Violence

Download or read book Domestic Violence written by Eva Schlesinger Buzawa and published by Praeger. This book was released on 1992-09-30 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: The markedly increased attention focused on violence within families has gripped the concerned interest not only of academic researchers but also that of the public and its law enforcement and criminal justice segments. Contemporary recognition of the widespread problem of abuse within the home, often dramatically and poignantly detailed, has not, however, led to clear and universally accepted public institutional responses. This authoritative volume presents a comprehensive evaluation of approaches, policies, and practical enforcement measures that have been effected by law enforcement and criminal justice bodies. The development of changes in social attitudes to spousal abuse; the role of the police and the practical interventions they may impose when contacted; the ramifications which decisions to prosecute may have on defendants' subsequent behavior; and the victims' responses to public interventions are topics that are all covered by this book. It is a current, substantive, and practically instructive volume on a social issue of vital importance.

Book The Prosecutor s Role in Helping Domestic Violence Victims

Download or read book The Prosecutor s Role in Helping Domestic Violence Victims written by Latasha Jackson-McDougle and published by . This book was released on 2014 with total page 63 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study examines the Prosecutors role when handling Domestic Violence cases and how they can better help serve battered women and their children without re-victimizing them through the Criminal Justice Juridical system by reviewing secondary survey data. Two statistical analyses were performed to determine if the current way Prosecutors are handling domestic violence cases are in favor to help the battered woman and their children or is it revictimizing them and not helping them be safe. The hypothesis predicts there is a positive relationship between battered women and their children being re-victimized by the legal system and process.

Book Battered Women and Feminist Lawmaking

Download or read book Battered Women and Feminist Lawmaking written by Elizabeth M. Schneider and published by Yale University Press. This book was released on 2008-10-01 with total page 331 pages. Available in PDF, EPUB and Kindle. Book excerpt: Women’s rights advocates in the United States have long argued that violence against women denies women equality and citizenship, but it took a movement of feminist activists and lawyers, beginning in the late 1960s, to set about realizing this vision and transforming domestic violence from a private problem into a public harm. This important book examines the pathbreaking legal process that has brought the pervasiveness and severity of domestic violence to public attention and has led the United States Congress, the Supreme Court, and the United Nations to address the problem. Elizabeth Schneider has played a pioneering role in this process. From an insider’s perspective she explores how claims of rights for battered women have emerged from feminist activism, and she assesses the possibilities and limitations of feminist legal advocacy to improve battered women’s lives and transform law and culture. The book chronicles the struggle to incorporate feminist arguments into law, particularly in cases of battered women who kill their assailants and battered women who are mothers. With a broad perspective on feminist lawmaking as a vehicle of social change, Schneider examines subjects as wide-ranging as criminal prosecution of batterers, the civil rights remedy of the Violence Against Women Act of 1994, the O. J. Simpson trials, and a class on battered women and the law that she taught at Harvard Law School. Feminist lawmaking on woman abuse, Schneider argues, should reaffirm the historic vision of violence and gender equality that originally animated activist and legal work.
