The study consists of four sections: an overview of the greater Austin MSA and the developing poverty in the suburban areas, a literature review of the effects of local land use policies on affordable housing production and development, the establishment of a "best practices" metric for local land use policies amenable to affordable housing production, and application of the metric to four localities in the Austin MSA, including Elgin, Dripping Springs, Kyle, and Georgetown. The findings reveal primarily low scores overall for the four localities, and expose the challenges suburban jurisdictions in a high-growth MSA in Texas face when addressing the needs of increasing low-income residents, and display best practices that localities with successful methods use to address those needs.

Book excerpt: In many of the biggest and richest cities in America, there is a housing affordability crisis. Housing prices in these cities have appreciated well beyond the cost of construction and even faster than rising incomes. These price increases are a direct result of zoning rules that limit the ability of new supply to meet rising demand. The high cost of housing imposes a heavy burden on poorer and younger residents and, by forcing residents away from these human capital rich areas, has even reduced regional and national economic growth. While scholars have done a great deal to identify the problem, solutions are hard to come by, particularly given the strong influence of neighborhood “NIMBY” groups in the land-use process that resist any relaxation of zoning limits on housing supply. In this Article, we argue that binding and comprehensive urban planning, one of the most criticized ideas in land-use law, could be part of an antidote for regulatory barriers strangling our housing supply. In the middle of the last century, several prominent scholars argued that courts should find zoning amendments that were contrary to city plans ultra vires. This idea was, however, largely rejected by courts and scholars alike, with leading academic figures arguing that parcel-specific zoning amendments, or “deals,” provide space for the give-and-take of democracy and lead to an efficient amount of development by encouraging negotiations between developers and residents regarding externalities from new building projects. We argue, by contrast, that the dismissal of plans contributed to the excessive strictness of zoning in our richest and most productive cities and regions. In contrast with both planning's critics and supporters, we argue that plans and comprehensive remappings are best understood as citywide deals that promote housing. Plans and remappings facilitate trades between city councilmembers who understand the need for new development but refuse to have their neighborhoods be dumping grounds for all new construction. Further, by setting forth what can be constructed as of right, plans reduce the information costs borne by purchasers of land and developers, broadening the market for new construction. We argue that land-use law should embrace binding plans that package together policies and sets of zoning changes in a number of neighborhoods simultaneously, making such packages difficult to unwind. The ironic result of such greater centralization of land-use procedure will be more liberal land-use law and lower housing prices.

The problem has elicited a variety of societal and public policy responses over the years, concomitant with fluctuations in the economy and changes in the demographics of and attitudes toward poor and disenfranchised citizens. In recent decades, federal agencies, nonprofit organizations, and the philanthropic community have worked hard to develop and implement programs to solve the challenges of homelessness, and progress has been made. However, much more remains to be done. Importantly, the results of various efforts, and especially the efforts to reduce homelessness among veterans in recent years, have shown that the problem of homelessness can be successfully addressed. Although a number of programs have been developed to meet the needs of persons experiencing homelessness, this report focuses on one particular type of intervention: permanent supportive housing (PSH). Permanent Supportive Housing focuses on the impact of PSH on health care outcomes and its cost-effectiveness. The report also addresses policy and program barriers that affect the ability to bring the PSH and other housing models to scale to address housing and health care needs.

Book excerpt: Rural America is progressing through a dramatic and sustained post-industrial economic transition. For many, traditional means of household sustenance gained through agriculture, mining and rustic tourism are giving way to large scale corporate agriculture, footloose and globally competitive manufacturing firms, and mass tourism on an unprecedented scale. These changes have brought about an increased presence of affluent amenity migrants and returnees, as well as growing reliance on low-wage, seasonal jobs to sustain rural household incomes. This book argues that the character of rural housing reflects this transition and examines this using contemporary concepts of exurbanization, rural amenity-based development, and comparative distributional descriptions of the "haves" and the "have nots". Despite rapid in-migration and dramatic changes in land use, there remains a strong tendency for communities in rural America to maintain the idyllic small-town myth of large-lot, single-family home-ownership. This neglects to take into account the growing need for affordable housing (both owner-occupied and rental properties) for local residents and seasonal workers. This book suggests that greater emphasis be placed in rural housing policies that account for this rapid social and economic change and the need for affordable rural housing alternatives.
