By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. This volume in the ICJ series provides practitioners, researchers and students with a detailed account of forms of leadership liability and an innovative approach to the topic’s most discussed issue. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years. His legal clerkship led him to organized crime investigations, criminal defence, the European Commission and the German Federal Ministry of Justice.

Understanding political violence is a complex task, which involves a variety of operations, from examining the social macro-structures within which actors engage in violence, to investigating the motives and drives of individual perpetrators. This book focuses on the faculty of imagination and its role in facilitating our normative and critical engagement with political violence. It interrogates how the imagination can help us deal with past as well as ongoing instances of political violence. Several questions, which have thus far received too little attention from political theorists, motivate this project: Can certain forms of imagination – artistic, historical, philosophical – help us tackle the challenge of comprehending and responding to unprecedented forms of violence? What is the ethical and political value of artworks depicting human rights violations in the aftermath of conflicts? What about the use of thought experiments in justifying policy measures with regard to violence? What forms of political imagination can foster solidarity and catalyse political action? This book opens up a forum for an inclusive and reflexive debate on the role that the imagination can play in unpacking complex issues of political violence. Traditional exegetical scholarship has treated Paul's presentation of reconciliation as referring to reconciliation between people and God, and has primarily focused use of the word katallage - traditionally translated as 'atonement'. Constantineanu challenges this view and argues that Paul's understanding of the concept is more complex, employing rich symbolism to describe reconciliation with God and between human beings forming together an inseparable reality. The discussion is placed within Paul's overall religious, social and political contexts, showing that an analysis of the social dimension of reconciliation in his thought is both plausible and necessary. Constantineanu offers an analysis of two major sections of Romans, chapters 5-8 and 12-15. Special emphasis is placed on Paul's use of the story of Jesus for community formation, for the shaping of identity, values and community practices. It is thus demonstrated that for Paul God's reconciling initiative, shown in the crucifixion, is not only the pronouncement of God's reconciling the world, but also the ground and model for reconciliation among human beings. Drawing on Hannah Arendt and Oliver O'Donovan, de Graaff argues that Bell and Bonhoeffer's story can be read as one of friends assuming the responsibility of political judgment in an emergency situation - their story casts doubts on secular politics as the primary context for interpreting the friends' judgments. Thus the book provides a more comprehensive account of the story, also interpreting it against the background of the life of the church (with special attention to John 15 and Romans 12). De Graaff concludes by showing how a theological account is vital for discerning the distinct politics of the church, including opportunities for Christian engagement in secular politics.
