Book excerpt: Although proven effective in protecting pregnancy, giving birth and breastfeeding – that is, the biological differences of women related to maternity – the current European Union (EU) legislative framework on maternity leave tends to overlook the roles of both parents, especially during the post-delivery period of ‘bonding’ with the child. This framework, along with EU law on parental leave, which does not encourage an equal take-up of the leave, gives rise to serious issues of gender equality affecting both men and women. This deeply researched and urgent book proposes alternative options for future EU law on child-related leave which can be applied to both employees and self-employed workers to mitigate these limitations and side effects. Analysing the various EU Directives which, directly or indirectly, relate to maternity leave, paternity leave, adoption leave and parental leave, as well as the corresponding case law of the Court of Justice of the EU, the author uses a social risk approach and tackles the following issues: narrow focus of the legislation on the delivering mother’s incapacity to work; in practice, excessive emphasis on the protection of the delivering mother; silent assent to the unequal distribution of caring responsibilities within the family; lack of attention to women’s labour market outcomes; and the new direction followed by the recently adopted Directive on work-life balance. The research focuses on working parents (including non-delivering parents in same-sex couples or adoption) and includes a comparative analysis of the law of six countries – Belgium, Ireland, Spain, the United Kingdom, Sweden and Portugal – chosen to illustrate the variety of national schemes available and how their desirable features can be introduced into EU law. A more balanced design of child-related leave is a must in today’s society for reasons of fairness and also for economic considerations. This complete analysis of EU legislation and case law about child-related leave – including the first-ever systematic and in-depth analysis on whether maternity leave can be considered discriminatory against fathers and a review of economic literature on how child-related leave affects the situation of women in the labour market – offers forward-looking solutions for child-related leave to enhance gender equality. In doing so, it addresses a gap in existing academic and policy documents to demonstrate how motherhood and femininity are presented in contemporary state-supported Danish screen fiction. As an industry premised on state funding and public service values, Danish screen fiction plays a cogent role in shaping and communicating cultural norms and provides a space for the cultivation of belonging and a sense of a shared identity. For this reason, it is vital to identify and examine representational trends and patterns in popular media formats. This book argues that the political narrative of gender equality, democracy and universal social support that permeates Danish state policy is undermined in screen fiction, wherein working mother characters are problematised and the welfare system’s integrity is challenged. This book asserts that the framing of femininity, motherhood and citizenship in many contemporary Danish films and television dramas indicates a cultural concern about the welfare state’s institutionalisation of caregiving and presents absent mothers as an indirect cause of crime, trauma or social unrest.

Book excerpt: Provisioning for basic human needs is done in three main kind of institutions: the familial household; the commercial enterprise selling goods and services; the institutions of the Welfare State that provide education, medical care and other goods and personal services to all or to some specific groups of citizens in need. The purpose of this book is to study the interplay of these institutions and their impact on well-being, and to analyze key policies and measures that have been implemented in European countries. Institutions determine labour demand (men and women are hired by the institutions of the Welfare State or by market providers of care), the possibilities of consumption (wages earned can be used to buy goods and services only if such goods and services are provided by the market) and allocate people's time, in particular women's time, between paid work and unpaid domestic production and provision of care, shaping both the gender relations and time use of people of both sexes. The proper balance of these institutions is a prerequisite of well-being both of the care givers and of the care receivers, and also for satisfactory gender relations. The chapters in this book focus on the following sub-topics: gender and welfare regimes; gender, well-being and the provision of care in the family and the household; and gender and well-being in the labour market. They emphasise the interdependence of social and labour market policies in the context of fundamental changes in both working patterns (the increase in female labour-force participation rates) and social needs (including population ageing) and demonstrate that we need a more integrated approach to welfare policy which takes account not only of basic welfare entitlements, but also the need for supportive forms of service provision and employment regulation.
