Book excerpt: Le droit administratif français fait actuellement l'objet de mutations, illustrées notamment par la création d'instances de régulation (AMF, CSA, ARCEP, CRE, ARMT). L'idée de régulation, malgré son omniprésence, suscite toujours des interrogations. Le présent ouvrage a pour ambition de proposer une définition juridique de la régulation. Si la référence à la dimension extra juridique de l'objet de l'étude ne permet pas son identification, la régulation est " saisie " par le droit administratif comme une nouvelle fonction juridique. " Fonction-objet ", elle se concrétise dans la théorie de l'acte juridique. L'étude des pouvoirs des organes dits officiellement " de régulation " révèle l'inadéquation d'une telle qualification à partir des prérogatives décisionnelles classiques. En revanche, il existe une communauté d'actes " innommés " permettant de la définir précisément. Les " actes de régulation " présentent des caractères originaux à même de les situer dans la typologie des actes administratifs : un contenu invitatif résultant de leur appartenance à la soft law, une nature effective et un processus d'élaboration informel. L'étude explore également la façon dont la logique de la régulation s'articule avec les thèmes fondamentaux du droit administratif. La nature des organes chargés de cette fonction dont, notamment, les autorités administratives indépendantes et les autorités publiques indépendantes personnalisées, le rapport de cette activité à l'intérêt général et à la puissance publique, ou encore les modalités du contrôle juridictionnel exercé par le juge administratif font de la régulation une activité administrative originale. Le droit administratif s'approprie la fonction de régulation et, réciproquement, la dynamique de la régulation l'affecte en retour. La régulation constitue une véritable notion de droit public qui favorise une relecture du droit administratif et soulève la question de la flexibilité de ses notions et techniques face à des formes juridiques nouvelles.

The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
