Book excerpt: The Royal Financial Administration and the Prosecution of Crime in France, 1670–1789 explores the French monarchy’s role in financing criminal prosecutions in the royal courts of the realm—the payment of criminal frais de justice in the vocabulary of the ancien régime—between 1670 and 1789 (that is, from the codification of criminal judicial procedure in the early period of Louis XIV’s personal rule to the outbreak of the French Revolution). The subject brings together three areas of scholarly inquiry—criminal justice, royal administration, and the management of the crown’s finances. A central goal of the study is to provide factual information and interpretive insights on each of these topics and to explain the relationship of each to the others over a long time period. The book contributes to existing scholarship in four ways. First, although each of the major dimensions of the inquiry—the operation of the criminal justice system, the conduct of the royal administration, and the management of the monarchy’s finances—has a large and increasingly sophisticated historical literature, this is the first study to combine them in a systematic way. Second, the long time period covered in the book not only enables the historian to distinguish gradual from rapid change, but it also allows the reader to view how the system functioned in different historical contexts. Third, the study is based on archival sources throughout France. This comprehensive approach permits the identification of elements of a common experience without sacrificing attention to important aspects of regional diversity. Finally, with respect to the sources themselves, the range is broad, encompassing regulatory acts and decisions of the king’s councils; administrative correspondence at the central, regional, and in some cases local levels; financial accounts and related papers; and court records from the major appellate courts and from several lower courts as well. An appendix of 33 tables lists figures of annual expenditure and other pertinent financial operations for each of the major financial districts of the kingdom.

The complex notion of class and the peculiarities of each region in France during the Ancien Régime make it difficult for historians to render a general portrait of the provincial French aristocracy. This study describes the economic interests and investments of noblemen in Toulouse. Some of their activities follow the classic pattern of "seigniorial reaction" and thus illustrate ideas posed by Marc Bloch. Others suggest that the Toulousian gentlemen were conscientious landlords. The Toulousian noble was essentially a gentilhomme campagnard, a country gentleman, in regard to his source of revenue, his outlook, and his mode of living. This book should make clear the full meaning of this expression.

But the second half of this personal rule has, until recently, received significantly less scholarly attention than the 1660s and 1670s. This has obscured some of the very real changes and developments that occurred between the early 1680s and the mid-1690s, by which time a new generation of younger royals had come to prominence, France was engulfed in international war on a greater scale than ever before, and the king was visibly no longer as vigorous or healthy as he had once been. This is the first scholarly study of the political and economic relationship between Louis XIV and the parlements of France, the Parlement of Paris and all the provincial tribunals. The author explains how the king managed to impose strict political discipline for which this reign, and only this reign, is known. Hurt shows that the king built upon that discipline to extract large sums of money from the judges in the parlements, thus damaging their economic interests. When the king died in 1715, the regent, Philippe d’Orléans, after a brief attempt to befriend the parlements through compromise, resorted to the authoritarian methods of Louis XIV and perpetuated the Sun King’s political and economic legacy. This study calls into question current revisionist understanding of Louis XIV and insists that absolute government had a harsh reality at its core. Based upon extensive archival research, this remarkable book will be of interest to all students of the history of early modern France and the monarchies of Europe.

The author first considers the growth of the French state in its ideological and institutional aspects, then the opposition such developments provoked, much centred on the figure of Cardinal Mazarin. In the last section particular attention is given to fiscal history, including a comparison of mid-18th-century France with the other states of Europe. Professor Bonney would argue that the ’fiscal imperative’, the increased requirements posed by the costs of war, and the long-term consequences of fiscal growth may be seen as one of the decisive factors in the development of the modern state.
