It then provides an analysis of selected legislative and oversight issues that Congress may consider when debating the reauthorization of ONDCP. Policymakers may question the status of the war on drugs, whether drug use should be seen as more of a law enforcement issue or a public health issue, and whether drug control resources are more effective when directed toward prevention and treatment or toward law enforcement. Another issue for consideration is whether the National Drug Control Budget--as currently conceived--represents a comprehensive view of federal drug control activities in the United States. Further, Congress may exercise oversight over ONDCP's means of evaluating the nation's federal drug control programs.

Book excerpt: Authorization of the Office of National Drug Control Policy (ONDCP) expired on September 30, 2003. Located in the Executive Office of the President, the ONDCP Director, often referred to as the "drug czar," is responsible for overseeing and coordinating the federal war on drugs and directly runs certain drug control programs such as the High Intensity Drug Trafficking Area (HIDTA) program, the National Youth Anti-Drug Media Campaign, and the Counter-Drug Technology Assessment Center. The office was created in 1988 and reauthorized twice since then. A bill has been introduced in the House (H.R. 2565) that would extend ONDCP by repealing the sunset provision of the agency's 1998 reauthorization act and authorize appropriations through 2010. The main purpose of the bill, however, is to impose drug-testing regulations on professional sports leagues. More extensive ONDCP reauthorization bills are reportedly being drafted by the House Government Reform Subcommittee on Criminal Justice, Drug Policy and Human Resources and the Senate Judiciary Subcommittee on Crime and Drugs. These bills will likely resemble the reauthorization bills introduced in the 108th Congress, H.R. 2086 and S. 1860. This report's comparison and analysis of the provisions of these bills from the 108th Congress are therefore of continuing relevance to the 109th Congress as it prepares to consider reauthorization of the office of the drug czar.

These reports show a consistent theme: the nation's effort to control illegal drugs is complex, fragmented among many agencies, and hindered by the absence of meaningful performance measures to gauge progress and to guide decisionmaking to better ensure that limited resources are put to the best use. In 1983, GAO concluded that there was a need to coordinate the nation's drug control efforts and recommended that the President make a clear delegation of responsibility to one individual to strengthen oversight of federal drug enforcement programs. Since then, GAO has periodically concluded that there is a continuing need for a central planning agency. Congress addressed this issue through the Anti-Drug Abuse Act of 1988, which created the Office of National Drug Control Policy (ONDCP) to better plan a nationwide drug control effort and assist Congress in overseeing that effort. 0NDCP was initially authorized through November 1993 and later reauthorized through September 30,1997.
