Book Enrichment in the Law of Unjust Enrichment and Restitution

Download or read book Enrichment in the Law of Unjust Enrichment and Restitution written by Andrew Lodder and published by Bloomsbury Publishing. This book was released on 2012-07-06 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: Enrichment is key to understanding the law of unjust enrichment and restitution. This book provides a comprehensive analysis of the concept of enrichment and its implications for restitutionary awards. Dr Lodder argues that enrichment may be characterised either factually or legally, and explores the consequences of that distinction. In factual enrichment cases, the measure of enrichment is the objective value received. This is the basis of many awards of money had and received, quantum meruit, quantum valebat and money paid. In legal enrichment cases, the benefit is the acquisition of a specific right or the release of a specific obligation. The remedy is restitution of that right or reinstatement of that obligation. It is demonstrated that specific restitution of the defendant's legal enrichment is often the basis for resulting trusts, rescission, rectification and subrogation. This book has profound implications for understanding restitutionary awards and the relationship between the enrichment inquiry and other aspects of the law of unjust enrichment, including the 'at the expense of' inquiry and the defence of change of position.

Download or read book In Reasonable Hope written by Patrick Masterson and published by CUA Press. This book was released on 2021-03-19 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Reasonable Hope considers three foundational responses to this quest for some understanding of the existence, meaning, and value of everything. Other approaches can be considered as combinations or variations of these. Firstly, there is the approach which claims that it is our humanity, exercising its unique intelligent subjectivity, that is the source and measure of all possible meaning and value. Nothing can be thought of as existing, meaningful or of value apart from a thinking human subject. This is a broadly Humanist approach to ultimate meaning. Man is the measure of all things. Secondly, there is the approach of Scientism. This claims that an ultimate understanding of the world and ourselves must be sought, less anthropocentrically, in terms of the findings of basic empirical sciences such as physics and chemistry. We live in a world ever-increasingly dominated by the autonomous system of science and technology. Such Scientism implies an explicitly reductionist and materialist conception of the meaning and value of everything. Thirdly, there is the approach of Theism which maintains that, in the final analysis, the meaning and value of everything, insofar as this can be known, is to be explained in terms of a transcendent infinitely perfect personal being we call God. The first two approaches are carefully considered. However, it is the third to which most attention is devoted. Consideration is given to the traditional impersonal metaphysical approach to questions about the existence and nature of God. The alternative approaches of linguistic philosophy and phenomenology, which reject such metaphysical speculation are also discussed. These various approaches are judged to be complementary rather than strict alternatives. In the latter half of the book is devoted to a more personal and self-involving discussion of the relevance of an affirmation of the existence of God. It explores the implications of a rational commitment to live one's life in accordance with the requirements of values which transcend explanation in purely physical terms, such as truth, goodness, beauty, and especially love. It provides a personal and existential development of the rational hope that such values are ultimately more objectively real and dependable than the eventual universal material chaos predicted by empirical science. It argues that the existence of God as the infinite expression and source of these values is the necessary and sufficient condition of this rational hope in their enduring significance. Finally, there is an account of how the Christian Revelation illuminates and transforms our rational hope in the enduring significance of love of God and neighbor.

Book Data Driven System Engineering

Download or read book Data Driven System Engineering written by James Wen and published by James Wen. This book was released on 2022-02-04 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides full scope of automotive ECU development activities including cybersecurity and safety plus SOTIF. Every computing system has two, and only two attributes: Data Value and Data timing, which represent fully the system functionalities from the system external behavior point of view. The data driven system engineering is the approach to develop the system by focusing on the two attributes mentioned above, in which, the data values are derived by the system operation concept design, and the data timing is derived by the system latency design. Based on which, this book provides a full range of system and software engineering development activities: Requirement Elicitation Requirement Engineering System and Software Architecture Design System Operation Concept Design System and Software Structure Design Electronic Architect Design Functionality Allocation Failure Mode and Effect Analysis (FMEA) Safety including SOTIF Cybersecurity (full compliant with UN ECE 155/156) System and software Verification System and Software Integration and Verification System and Software Black Box Verification each of which has its own clearly defined scope and approach, which is different from the conventional development, in some cases even different from some ISO standards, for example: Safety Development: the safety requirements for every part in a vehicle are cascaded from the vehicle safety requirements, which is different from the Concept Phase in the Part 3 of ISO 26262, and the functional safety development will be fully covered by (1) Reliability (2) Availability (3) Quality. Error Detection and Protection: there are only two types of errors to be detected in a computing system: Data Value error and Data Timing error, to detect which, there are only two aspects to be considered: (1) input data (2) middle data and output data in addition to the platform error detection. The approaches of detection and protection include (1) data transfer protocol check, (2) data range and reasonable value check, (3) execution time check and control. FMEA: this book provides the optimized approach by following the data relationships between the input data, middle data and output data, which will be both inductive and deductive, and re-use the system operation concept that is built at the system development first phase, to make the development efficient. Cybersecurity: this book provides the full solution to cover the UN ECE 155 by implementing three aspects: (1) Trusted contents in the ECU (2) Authenticated access to the ECU (3) Authenticated communication with the ECU. Requirement Engineering: This book makes the goal and scope of requirement engineering in the computing system development specific, accurate and measurable by defining the scope as: the requirement engineering is to use the computer executable information to describe the system under development which consists only two types of information: Signal and Test Case, and defining the requirement quality measurement as: (1) Signals, either input or output signals, shall be computer readable. (2) Test cases shall be executable in the system. System Architecture Design: The goal of system architecture design is to provide the platform that transfers and transforms the input signal to become the required output signal via some middle data. This book introduces the following system functional modulizations based on the AUTOSAR that satisfies a generic automotive ECU structure: (1) Feature Function (2) Diagnostic Service (3) Cybersecurity Function (4) Serial Signal Manager (5) Application Mode Manager (6) AUTOSAR, and based on the characteristics of those functions, the book provides the approach to design the electronic architecture and allocate the functions to the architecture.
