Book excerpt: Current copyright law is struggling with its adaptation to the digital environment and the time does not seem to remedy the problems we are facing. In this paper it is argued that the current structuring of the economic rights is a serious obstacle both to explaining the essence of copyright law to the public being affected by it 24/7 and to getting a proper grip of the emerging problems. It is suggested that the current “six stages structure” (exclusive rights/exceptions, protection of DRMs/exceptions, secondary liability/safe harbors) be replaced by a one stage structure predicated on the notion that right holders have exclusive rights to a reasonable exploitation, drawing in this respect also on the criteria of the “three step test(s)” of the international conventions. The challenge is to put up a regulatory framework that balances needs for predictability with the urge of flexibility and the idea and the contours of an alternative model for restructuring the economic rights are sketched out in the paper.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Book excerpt: This book aims to unravel how rural gender regimes are constituted, enforced, made sense of and resisted, and how struggles of resistance lead to empowerment and change in various countries in the four corners of Europe as well as Australia and India. The book focuses on the intricate relationship between laws and institutions and everyday life. It analyzes on the one hand how laws and institutions are constituted and on the other hand how gender regimes are built at the local rural level, sometimes in compliance with these frames and sometimes contesting them. The articles, in diverse ways, give voice both to women's struggles for recognition and men's voices in gendered rural societies. Through applying the concepts of the welfare state and gender regimes within rural research, this book contributes to the further development of a comparative theoretical framework for rural gender studies. The importance of integrating rural gender studies into both the mainstreams of rural and feminist research has been emphasized in previous research, as has that of developing comparative analytical frameworks. The conceptual framework adopted in this volume sets out to meet this challenge by approaching rural gender relations as the meeting point of two core research areas: gender regimes and rural transformative processes. Research into gender regimes offers a promising analytical framework for comparing gender relations in diverse rural settings. At the same time, by addressing rural concerns deriving from the specificity of rural transition processes and gender regimes, the approach also contributes to an elucidation of the complexity of citizenship. Restructuring Capitalism: Materialism and Spiritualism in Business argues that what is needed is a new sense of a spiritualization of the self and its relation to others and to the establishment of a spiritual connection with nature in order for capitalism to be restructured to work for everyone and for the society as a whole.

Thousands of people regularly watch sports events online and offline and in society the topic of a team‟s or an individual‟s performance is always passionately discussed. Taking a look at Europe the most popular sport is football. Mughai (2016, p. 13) elaborates that football – or sometimes called soccer to avoid interchanging with American football – is globally ranked first in terms of popularity. Supporters that are very passionate about their team are visiting the huge football stadiums week by week. As the capacity of a stadium is limited sometimes fans are even purchasing their entrance tickets weeks or months ahead of the event itself. Especially the German Bundesliga has been facing an enormous interest growth within the last years resulting in an average of 42.609 visitors per match day making the league the most visited one in Europe. (DFL, 2015, p. 22f) Similar to the ever-growing popularity of sports, the costs are rising. This is caused by mounting player salaries, increased transfer fees and other operational expenses. (Drayer, Lee & Shapiro, 2012, p. 184; Breuer & Kemper, 2015, p. 142) Sport clubs therefore need to steadily open up and augment their sources of revenue: match day revenues, advertising, broadcasting, transfer fees and merchandising. (DFL, 2015, p. 26f) Some of these revenue streams can be actively influenced by the Bundesliga clubs whilst others are hard to affect. One of the determinants that can be modified is ticket pricing. The objective of this Master Thesis is to explain the prevailing pricing strategy in the German Bundesliga and to present innovative, value-based pricing approaches which can be tested. Creating an understanding of the fans‟ willingness to pay and factors having impact on the purchase decision making process, a gap in research is supposed to be filled. In this Master Thesis the author aims to find sufficient, relevant, reliable and empirically proven answers to the following research questions: 1) Why have innovative value-based pricing strategies like dynamic pricing not yet been implemented in the German Bundesliga? 2) To what extant are fans willing to pay different prices depending on dynamic factors? 3) What determinants need to be taken care of when changing the prevailing pricing strategies of Bundesliga clubs?
