In contrast to the prevailing view that citizens' decisions about the legitimacy of their governments are strongly conditioned by political culture and socialization and are hence largely non-rational, Ronald Rogowski argues that such decisions may indeed be the product of rational choice. The book proceeds both from recent work in the theory of voting and constitutional choice and from the older tradition of contract theory to postulate that decisions about legitimacy are really choices among alternative regimes. The author suggests that members of a society choose among these alternative regimes on the basis of a knowledge of ethnic and occupational divisions in their society. From these postulates a general theory is derived, which finds expression in numerous testable hypotheses. Originally published in 1974. This book examines the concept of political legitimacy within the European Union through the principles of legal rationality, focusing in particular on the European Union’s policy towards third country nationals. Richard Ball argues that for legal doctrine to be rational it must display the requirements of formal, instrumental and substantive rationality, each mutually exclusive and essential. In taking this position of legal rationality, the book focuses on free movement rights of TCNs within EU treaties and implementing legislation, the Area of Freedom Security and Justice, and Association Agreements. Ball concludes that the stance of European Union Law towards third country nationals lacks legitimacy, and suggests possible new directions that EU policy should take in the future.

Book excerpt: This book provides an account and explanation of a fundamental dilemma facing secular states: the 'legitimacy gap' left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The 'secular' in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a 'substantive' legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of 'procedural' legitimacy (people, rights, and culture) in different ways: the 'neutral model' (constitutions based on the 'displacement of culture'); the 'multicultural model' (constitutions based on diversity and pluralism); and the 'asymmetric model' (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards 'nationalization' linked to a particular national identity (as in France and, to some extent, in India)-or towards 'de-secularization', whereby secularism is displaced by particular cultural norms, as in Malaysia.

Schaar sees what were once authoritative institutions and ideas yielding to technological and bureaucratic orders. The later brings physical comfort and a sense of collective power, but does not provide political liberty or moral autonomy. As a result, he argues, all modern states exhibiting this transformation of authority into technology are well advanced along the path of a crisis of legitimacy.

Using Max Weber’s typology of legitimacy, the book explains that the Islamic Republic’s legitimacy was based on the charismatic authority of the regime’s founder, Ayatollah Ruhollah Khomeini. Since Khomeini’s death in 1989, the regime has failed to develop the rule of law necessary for legal-rational authority. Moreover, it abandoned the logical underpinnings justifying clerical rule when a mid-ranking cleric rather than a Grand Ayatollah was placed in the position of Supreme Leader. With neither a legal basis nor a traditional basis of authority, the new leader relied extensively on the cover of Khomeini’s charismatic shadow for legitimacy. After nearly four decades, this shadow is fading. Not only will Khamenei’s successor lack the same direct ties to Khomeini, but the demographic and societal changes in Iran have made the charisma of Khomeini a historical concept rather than a viscerally felt experience. First the book analyzes the likely succession scenarios, finding the most probable outcome is the appointment of a hardline conservative backed by the regime’s security forces. Next, the regime’s economic, political, and social failures are presented, in order to explain why the new leader is likely to try to return to a traditional basis of legitimacy – religion. Thereafter, the book explains how this hardliner focus on religion is likely to result in an aggressive Iranian foreign policy toward the United States, Israel, and Saudi Arabia, impacting the region’s security.
