On the one hand, its increasing importance is closely linked to institutional reforms that strengthened the European Court of Human Rights' reputation vis-a-vis the Member States. On the other hand, and even more importantly, the ECHR's significance arises from a changing perception of its constitutional potential. Starting with the assumption that the ECHR is transforming the European constitutional landscape, this book shows that the European Convention raises unprecedented problems that involve, first of all, its own theoretical status as constitutional instrument that ensures the protection of human rights in Europe. Changing paradigms concerning its incorporation in domestic law, as well as the growing conflicts about the protection of some rights and liberties that are deeply rooted in national legal contexts (such as teaching of religion, bio law, and rights of political minorities), are jointly examined in order to offer a unified methodology for the study of European constitutional law centered upon human rights. The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.

However, since the beginning of the industrial era, these ecosystems have been subjected to strong anthropogenic pressures intensified from the second half of the 20th century, when there was a marked acceleration in the warming (climate change) of the continents, particularly at high latitudes. Coastal ecosystems are highly vulnerable to alteration of their physical, chemical and biological characteristics (marine intrusion, acidification of marine environments, changes in ecosystems, evolution and artificialization of the coastline, etc.).In contact with heavily populated areas, these environments are often the receptacle of a lot of chemical and biological pollution sources that significantly diminish their resilience. In this context of accelerated evolution and degradation of these areas important for food security of many populations around the world, it is necessary to better identify the factors of pressure and understand, at different scales of observation, their effects and impacts on the biodiversity and on the socio-eco-systems, in order to determine the degree of vulnerability of these coastal ecosystems and the risks they face. A transdisciplinary and integrated approach is required to prevent risks. Within this framework, operational coastal oceanography occupies an important place but also the implementation of a true socio-eco-system approach in order to set up an environmentally friendly development.
