Book excerpt: L’Autore si è concentrato sulla ricostruzione della prima fase del procedimento penale, che inizia con la ricezione della notitia criminis da parte della polizia giudiziaria o del pubblico ministero e termina quando quest’ultimo esercita l’azione penale o ottiene dal giudice l’archiviazione richiesta. La fase procedimentale non consente di regola il contraddittorio tra le parti, anche se prevede l’assistenza del difensore ad alcuni atti; d’altra parte, le indagini preliminari, precedendo l’esercizio dell’azione penale, prevedono interventi solo incidentali del giudice, che vede limitata la sua competenza all’atto eventualmente richiesto. Il PM e la PG svolgono le indagini preliminari per le determinazioni inerenti all’esercizio dell’azione penale; in altri termini, fino a quando sono in corso le indagini preliminari non esiste ancora un processo penale, né ve ne sarebbe uno qualora la notizia di reato venisse archiviata. Detto così, tutto parrebbe lineare; tuttavia non sempre è così chiaro. E’ qui che il volume mette allora a fuoco gli snodi delle indagini preliminari, consentendo all’interprete di chiarire i profili problematici della fase investigativa.

However it also looks at the populations subjected to French rule, at the nature of their resistance and adaptation to the principles of the Napoleonic project. This book is the first overall comparative study of Europe in the Napoleonic years. It is a study not only of an early exercise in imperialism, but of the conflict that is aroused between the rationalising tendencies of the modern state and the spatial and cultural heterogeneity of individual societies.
